Ordinance 1894J CITY OF ALAMEDA ORDINANCE NO. 1894 New Series AUTHORIZING THE TRANSFER OF CERTAIN CITY -OWNED PROPERTY TO THE CITY OF OAKLAND WHEREAS, the City of Alameda and the City of Oakland, acting by and through its Board of Port Commissioners, have heretofore entered into that certain Annexation Agreement, dated March 16, 1977 and authorized by City of Alameda Ordinance No. 1861 N.S., wherein said Cities agreed to an exchange of properties in order to facilitate the construction of a city line road in Alameda and place Port of Oakland owned and operated properties within the City of Oakland; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1 . For valuable consideration (City Line Road property), the City of Alameda hereby transfers unto the City of Oakland, a municipal corporation, acting by and through its Board of Port Commissioners, all that certain real property situate in the City of Alameda, County of Alameda, State of California, and more particularly described as follows: r All that portion of the salt marsh, tide and submerged lands, whether filled or unfilled, in the County of Alameda, State of California, which is a portion of the salt marsh, tide and submerged lands which were .x granted to the City of Alameda by an act of the > Legislature of the State of California by the Statutes q of 1913, Chapter 348, approved June 11, 1913, and in effect August 10, 1913, which grant was amended by a t; the Statutes of 1917, Chapter 594, approved May 24, i C F+ F= b 01 « -1 C -1- 1917 and in effect July 27, 1917, and said area being referred to in Section 2 of the Statutes of 1955, Chapter 1028 which authorized the City of Alameda to convey certain parcels of such lands to the City of Oakland, and being more particularly described as follows: BEING a portion of Sections 25 and 36 of Township 2 South, Range 4 West and Section 31 of Township 2 South, Range 3 West, Mount Diablo Base and Meridian which area is contiguous to and southwesterly of a portion of the general southwestern line of that certain map entitled, "Map No. 2 of Salt Marsh and Tidelands Situate in the County of Alameda, State of California, 1871," hereinafter called Map No. 2, and delineated in the field notes thereof all on file in the Office of the Department of Finance, Division of State Lands, State of California, and being more particularly described as follows: COMMENCING at a granite monument which marks the section corner common to Sections 19 and 30 of T2S, R3W and Sections 24 and 25 of T2S, R4W, MDB&M, said monument having the coordinates of Y= 454,723.06 feet and X= 1,495,709.58 feet based on the California Coordinate System, Zone III, as are all bearings, distances and coordinates in this description, as said monument is shown on that certain Map Delineating Boundary Of Territory Annexed To The City of Oakland, California By Ordinance No. 4986 CMS ... etc., filed August 17, 1956, in Book 40 of Maps, page 57 (AL- 87217), Records of Alameda County; thence along a line which bears South 06 1 45'50" East 5,777.27 feet (being a true bearing and distance of South 07 0 49'51" East 5,777.68 feet) to a point which has the coordinates of Y= 448,986.00 feet and X= 1,496,390.01 feet and is the TRUE POINT OF BEGINNING of the area being described, said point being on the northwestern boundary line of that certain territory annexed to the City of Oakland by Ordinance No. 4986 CMS, a map which was filed on August 17,1956, in Map Book 40, at Page 57, Records of Alameda County, said point also being on the northwestern line of that certain parcel described in the deed dated September 14, 1955, from the City of Alameda to the City of Oakland, recorded September 23, 1955, in Book 7792 of Official Records, at Page 177, Records of Alameda County; thence along said northwestern boundary line South 41 0 03'21" West 3,684.74 feet, thence leaving said City boundary line North 57 1 28'30" West 3,538.90 feet; thence North 41 °03'21" East 4,112.71 feet, more or less, to a point on the general southwestern line of the aforesaid Map No. 2, said point also being on the southwestern line of the 231.219 acre parcel of land -2- described in the Final Order of Condemnation against Utah Construction Company and in favor of the City of Oakland, a copy of which was filed on June 27, 1957, in Book 8402 of Official Records, at Page 55, Records of Alameda County; thence along last said line and along said general southwestern line of Map No. 2 South 48 1 22'31" East 2,578.34 feet to the section corner common to Sections 30 and 31 of T2S, R3W and Sections 25 and 36 of T2S, R4W, MDB&M; thence continuing along said general southwestern line of Map No. 2 South 68 1 37'15" East 978.68 feet to an angle point in the City of Oakland boundary line as established by the aforesaid Ordinance No. 4986 CMS (40M57); thence along last said boundary line South 41 1 03'21" West a calculated distance of 206.94 feet to the true point of beginning. Containing 311.526 acres, more or less. Section 2 . The Mayor of the City of Alameda is hereby authorized and directed to execute, for and on behalf of the City of Alameda, a Grant Deed conveying said real property to the City of Oakland, a municipal corporation, acting by and through its Board of Port Commissioners, and the City Clerk is directed to attest to the same. Section 3 .
