AMENDING SECTION 16 -514 OF THE ALAMEDA MUNICIPAL
CODE RELATING TO ISSUING AUTHORITY FOR EXPLOSIVE
PERMITS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 Section 16 -514 of the Alameda Municipal Code
is hereby amended to read as follows:
Sec. 16 -514 No person shall transport or use
explosives within the City for any purpose without
first obtaining permission of the Fire Chief of the
City or his designated representative.
Section 2 This ordinance is one of great necessity and
urgency within the meaning of Section 3 -12 of the City Charter,
is introduced and passed at the same Council meeting, and shall
hero.. effective nn April 5, 1.978.
Section 3 The f "acts constituting the necessity and
urgency hereof are:
(1) State law requires that the City designate the chief
or other head of its police department or the chief of its fire
department, and an authorized representative, to issue permits
for use of explosives within the City;
(2) Said designation is to be made within thirty days
of receipt of notice from the State Fire Marshall, which date
is April 1, 1978, or the County Sheriff becomes the issuing
authority;

(3) It is in the interest of the general welfare of
the City that a local representative control this particular
function;
(4) The normal procedure for introduction, hearing
and passage of an ordinance pursuant to Section 3 -12 of the
Charter would not be timely;
(5) This Council hereby finds, determines and declares
that it is in the best public interest and necessity that this
ordinance be introduced and passed at the regular meeting of the
City Council held April 4, 1978 and that this ordinance become and
be in full force and effect April 5, 1978.

in regular meeting assembled on the 4th day of April, 1978, by the following
