AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING
SECTION 3 -1421 OF CHAPTER 14OF TITLE III THEREOF
RELATING TO THE TRANSIENT OCCUPANCY TAX
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 . The Alameda Municipal Code is hereby amended
by amending Section 3 -1421 of Article 2 of Chapter 14of Title
III thereof, to read as follows:
Sec. 3 -1421 Tax Imposed For the privilege of
occupancy in any hotel, each transient is subject to and
shall pay a tax in the amount of eight percent (8% ) of
the rent charged by the operator. Said tax constitutes a
debt owed by the transient to the City which is extinguished
only by payment to the operator or to the City. The
transient shall pay the tax to the operator of the hotel
at the time the rent is paid. If the rent is paid in
installments, a proportionate share of the tax shall be
paid with each installment. The unpaid tax shall be due
upon the transient's ceasing to occupy space in the hotel.
If for any reason the tax due is not paid to the operator
of the hotel, the Tax Administrator may require that such
tax shall be paid directly to the Tax Administrator.
Section 2 . This ordinance provides for, and fixes the rate
of, a tax levy for the usual and current expenses of the City, and
pursuant to Section 3 -12 of the Charter of the. City of Alameda
shall be in full force and effect at 11:00 p.ii. on June 30, 1978.

Provided, however, this ordinance shall be of no force and effect
in the event that Proposition 13 is not adopted at the June 6,
1978 Primary Election of the State of California.
Section 3 . It is the intent of this Council, in the event
that Proposition 13 is either held unconstitutional or the State
provides revenues lost through the passage thereof, to repeal
this ordinance thereafter.
