AMENDING THE ALAMEDA MUNICIPAL CODE BY ADDING
SECTION 4 -217 TO ARTICLE 1, CHAPTER 2 OF TITLE IV
THEREOF PROHIBITING THE POSSESSION AND USE OF
ALCOHOLIC BEVERAGES IN JACKSON PARK
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 . Section 4 -217 is hereby added to Article 1,
Chapter 2, of Title IV of the Alameda Municipal Code to read:
Sec. 4 -217 Alcohol in Parks No person shall
possess or consume any alcoholic beverage in Jackson
Park within this City. "Alcoholic beverage" includes
alcohol, spirits, liquor, wine, beer, and every liquid
or solid containing alcohol, spirits, wine, or beer
which contains one -half of one percent or more of alcohol
by volume and which is fit for beverage purposes either
alone or when diluted, mixed or combined with other
substances.
Section 2 . This ordinance is one of great necessity and
urgency within the meaning of Section 3 -12 of the City Charter,
is introduced and passed at the same Council meeting and shall
become effective on October 18, 1978.
Section 3 . The facts constituting the necessity and
urgency hereof are:

1. That a nuisance problem has arisen in the City of
Alameda.
2. That this ordinance should be immediately effective
on passage to insure that citizens are not subjected to those
nuisances for even a short period of time.
3. That a potential health and safety problem will exist
if such regulation is not immediately effective.
4. That, in light of such potential health and safety
problems involved, the normal delay between enactment of this
ordinance and its effective date would be injurious.
5. This Council hereby finds, determines and declares
that it is in the best interest and necessity that this ordinance
be introduced and passed at the regular meeting of the City
Council held October 17, 1978 and that this ordinance become
and be in full force and effect October 18, 1978.

in regular meeting assembled on the 17th day of October, 1978, by the following

ABSENT: None.
