AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING
SECTIONS 17 -352 AND 17 -385 OF CHAPTER 3, TITLE XVII
THEREOF, RELATING TO THE TOWING AND REMOVAL OF
ABANDONED, UNLAWFULLY STORED OR UNLAWFULLY PARKED
VEHICLES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 . Article 5, Chapter 3, of Title XVII of the
Alameda Municipal Code is hereby amended by amending Section
17 -352 thereof to read:
Sec. 17 -352 Removal Every police officer, or
other person authorized by law, may take possession of
any vehicle left standing on the public streets in
violation of this article and remove same in the manner
authorized by Article 8, Chapter 3, Title XVII of this
Code.
Section 2 . Article 8, Chapter 3, of Title XVII of the
Alameda Municipal Code is hereby amended by amending Section
17 -385 thereof to read:
Sec. 17 -385 Towing Contractor When authorized
by City Council resolution any person or persons so
authorized may enter upon private property or public
property to remove or cause the removal of a vehicle or
parts thereof declared to be a nuisance pursuant to this
Article.

Section 2 . This ordinance is one of great necessity and
urgency within the meaning of Section 3 -12 of the City Charter,
is introduced and passed at the same Council meeting and shall
become effective on January 2, 1979.
Section 3 . The facts constituting the necessity and
urgency hereof are:
1. That traffic regulations are essential for the
orderly flow and control of traffic within the City.
2. That such regulations should necessarily be immediately
effective on passage to insure that maximum preservation of
public welfare is obtained.
3. That a potential health and safety problem will exist
if such amendments are not immediately effective.
4. That,,in light of such potential health and safety
problems involved, the normal delay between enactment of this
ordinance and its effective date would be injurious.
5. This Council hereby finds, determines and declares
that it is in the best interest and necessity that this ordinance
be introduced and passed at the regular meeting of the City
Council held January 2, 1979, and that this ordinance become
and be in full force and effect on said date.

This ordinance amends the Alameda Municipal Code by Amending Section 17 -352
to provide that every police officer, or other person authorized by law, may take
possession of any vehicle left standing on the public streets in violation of this
article and remove same in the manner authorized by Article 8, Chapter 3, Title XVII
of this Code; and by amending Section 17 -385 to provide that when authorized by
City Council resolution any person or persons so authorized may enter upon private
property or public property to remove or cause the removal of a vehicle or parts
thereof declared to be a nuisance pursuant to this Article.
This ordinance was enacted as an emergency ordinance under the provisions
of Section 3 -12 of the Alameda City Charter by a vote of 5 Ayes, 0 Noes, 4 Absent,
effective January 3, 1979.
Three full copies are available for use and examination by the public in
the Office of the City Clerk.
Notice thereof is hereby published pursuant to Section 3 -14 of the
Alameda City Charter.
