AUTHORIZING THE ACQUISITION OF CERTAIN REAL
PROPERTY FOR STREET, HIGHWAY AND GENERAL MUNICIPAL
PURPOSES (FERNSIDE BOULEVARD EXTENSION - 3288
ENCINAL AVENUE)
WHEREAS, public interest and necessity require that the
real property hereinafter described be acquired by the City of
Alameda for street, highway and general municipal purposes; and
WHEREAS, the owner of the property hereinafter described
is willing to sell the same to the City of Alameda for the sum
of SEVENTY -ONE THOUSAND, FIVE HUNDRED and 00 /100 DOLLARS
($71,500.00);
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF ALAMEDA:
Section 1 . That the City of Alameda purchase, for the
sum of $71,500.00, that certain real property situated in the
City of Alameda, County of Alameda, State of California, more
particularly described as follows:
That parcel of land in the City of Alameda, County
of Alameda, State of California, described as
follows:
Beginning at a point on the southwestern line of
Encinal Avenue, formerly "S. P. Co. R. R. ", distant
thereon 850 feet southeasterly from the south-
eastern line of Post Street, as said Avenue and
Street are shown on the "Map of the Hirschfeld Tract"
filed April 27, 1889, Map Book 11, page 73, Alameda
County Records; thence along said line of Encinal
Avenue, southeasterly 40 feet; thence southwesterly
parallel with said line of Post Street, 85.67 feet
to the direct extension southeasterly of the south-
western line of Lot 43, as said lot is shown on the
"Map of the Survey of 4 acre lots made by J. E.
Whitcher in Alameda," filed March 9, 1863, Map Book

5, page 7, Alameda County Records; thence north-
westerly along the last named line 40 feet; thence
northeasterly parallel with said line of Post
Street, 85.67 feet to the point of beginning.
on the following terms and conditions:
(a) That good and merchantable title in fee simple in
said real property be conveyed to the City of Alameda, free and
clear of all objections, liens and encumbrances.
(b) That the title of said real property be evidenced
by a policy of title insurance issued by Western Title Insurance
Company, insuring title inthe City, as provided in the preceding
subdivision.
(c) That upon deposit with said title company for
delivery to the City of a good and sufficient deed of grant
conveying said property to said City and conditioned upon the
issuance of a title insurance policy, as aforesaid, to be
approved by the City Attorney, a warrant of the City be drawn
for $71,500.00, payable to the order of and delivered to
Western Title Insurance Company, as escrow holder, for the
purpose of effecting the consummation of said transaction.
Section 2 . That the sum of $71,500.00, together with a
sum sufficient to cover cost of title insurance and other
incidental expenses to said transaction is hereby appropriated
from the Special Gas Tax Fund, Account No. 2222.2, to pay the
purchase price of said real property, cost of said title
insurance policy, and incidental expenses.
Section 3 . That this ordinance shall be in full force

and effect from and after the expiration of thirty (30) days
from the date of its final passage.

I, the undersigned, hereby certify that the foregoing
Ordinance was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the
18th day of March, 1980, by the following vote, to wit:
AYES: Councilmen Diament, Sherratt, Stone, Tillman
and President Corica - 5.
NOES: None.
ABSENT: None.
