Ordinance 2025CITY OF ALAMEDA ORDINANCE NO. 2025 New Series AMENDING AND REPEALING CERTAIN SECTIONS OF CHAPTER 1 OF TITLE XI OF THE ALAMEDA MUNICIPAL CODE RELATING TO A DESIGN REVIEW PROCEDURE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1 . The Alameda Municipal Code is hereby amended by repealing Section 11- 1354.4(e) thereof. Section 2 . The Alameda Municipal Code is hereby amended by amending Sections 11- 1357(c), 11- 1357.1, 11- 161.5(a), 11- 162.5(a), 11 -169 and 11- 1101(a) thereof, to read as follows: Sec. 11 -1357 Development Plan. (c) Elevantions, perspective drawings, models or other graphic representations sufficient to appraise the Board of the design of the various improvements of the project. Sec. 11- 1357.1 Development Plan Finalization Whenever approval of the Development Plan is conditioned on amendments thereto, the Planning Board may require an additional review to insure that all exhibits and texts of the approval comply with approvals given. Exhibits and text shall be designated the Final Development Plan when no further approvals are required by the Planning Board. Sec. 11- 161.5 Administrative Variance (a) Approval by zoning Administrator An applica- 10/28/80 _1_ tion for a variance to size or frontage requirements of lots, yard or open space requirements, or height limitation of buildings, fences, hedges, walls and other structures, may be approved by the Zoning Administrator where the Administrator determines that the conditions of Section 11- 161(b) have been met and that the reduction in require- ments is nonsubstantial. The Zoning Administrator may make approval conditional and may refer applications to the Planning Board. Sec. 11- 162.5 Administrative Use Permit (a) Approval by Zoning Administrator. An applica- tion for a use permit may be approved by the Zoning Administrator where the Administrator determines that the criteria of Section 11- 162(b) have been met and the applica- tion does not pose any special problems or require a change in conditions of approval. The Zoning Administrator may make approval conditional and may refer applications to the Planning Board. Sec. 11 -169 Design Review Coordination The Planning Board may request a report on the design review elements of any application. Sec. 11 -1101 Appeal to the City Council (a) The decision of the Planning Board made after public hearing shall be final unless a member of the public or a City Council member files, in writing and within -2- fifteen (15) days of the decision, a Notice of Appeal stating wherein the appellant claims that either the Board's decision is not supported by its findings or its findings are not supported by the evidence in the record. Section 3 . This ordinance shall not apply to building permit applications for structures for which tentative maps or zoning permits have been approved prior to September 21, 1979. Section 4 .
