Ordinance 2099CITY OF ALAMEDA ORDINANCE NO. 2099 New Series CONVEYING TO PONDEROSA HOMES, A CALIFORNIA GENERAL PARTNERSHIP, A WEDGE OF PROPERTY AT THE LINCOLN SCHOOL SITE CONSISTING OF APPROXIMATELY 0.004 ACRES OF LAND WHEREAS, by its Ordinance No. 2007 N.S. the City of Alameda transferred by grant deed to Ponderosa Homes its interest in a thirty - foot strip of land extending from the present end of Washington Street, containing 0.309 of an acre of land, more or'less; and WHEREAS, said grant deed contained an erroneous description in that it did not include a wedge of property consisting of approxi- mately 0.004 acres of land which had been abandoned by the City in connection with the construction of Fernside Boulevard; and WHEREAS, the Alameda Unified School District has conveyed to the City its interest in said 0.004 acre parcel; and WHEREAS, said "wedge" of property is not requied for municipal purposes and it would be in the public interest to convey same to the adjoining property owner; and WHEREAS, Ponderosa Homes, a California general partnership, owns the adjoining property which is known as Subdivision Tract 4136; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1 . The City of Alameda transfer by grant deed unto Ponderosa Homes, a California general partnership, all that certain real property situate in the City of Alameda, County of Alameda, State of California, more particularly described as follows: COMMENCING at the point of intersection of the northwestern line of the San Leandro Basin, as said line is shown on "Map No. 2 of Salt Marsh and Tide Lands, situate in the County of Alameda, State of California, 1871 ", certi- fied copies thereof having been filed with the County Recorder of the City and County of San Francisco, and in the office of Department of Finance, Division of State Lands, with the southwestern line of Block "C ", Tract 1849, as shown on the map thereof recorded June 6, 1958 in Map Book 38, page 87, Alameda County Records; THENCE along said northwestern line, south 49 °06'11" W. 917.78 feet (recorded 917.46 feet) to the intersection thereof with the southeasterly prolongation of the center Line of Washington Street; THENCE along last said line N. 47 0 40 1 35" W. 447.17 feet (recorded 446.97 feet) to the TRUE POINT OF BEGINNING, said point being on the southeasterly line of the roadway easement vacated by the City of Alameda Resolution No. 9276 on April 16, 1980, said vacated roadway easement being a portion of the Grants of Easement for public street, storm and sanitary sewers and public utilities filed August 16, 1976 in Reel 4486, Image 813, and filed September 7, 1976 in Reel 4515, Image 709, of the Official Records of Alameda County, said public street being commonly known as Fernside Boulevard; THENCE continuing along aforesaid prolongation of the centerline of Washington Street, being also the southwesterly line of said Grant of Easement filed in Reel 4486, Image 813, N. 47 °40'35" W. 7.13 feet to a point on the northwesterly line of said vacated roadway easement, a radial line of a curve having a radius of 644 feet hereinafter described through last said point bears S. 38 °37'23" E.; THENCE northeasterly along said curve concave northwesterly having a radius of 644 feet through a central angle of 02 °41'37" for an arc distance of 30.28 feet to a point through which a radial line of said curve bears S. 41 1 19 1 00" E., said point being at a line which is parallel to and lying north- easterly 30.00 feet measured perpendicularly from aforesaid prolongation of the center line of Washington Street; THENCE along last described line, S. 47 °40'35" E. 3.90 feet to a point on the aforementioned southeasterly line of the vacated roadway easement and being also the southeasterly line of the Grant of Easement filed in Reel 4486, Image 813, hereinabove referred to; THENCE southwesterly along last said line on a curve concave northwesterly having a radius of 844 feet (a radial line of said curve through last said point bears S. 47 °07'40" E.) through a central angle of 02 °02'15" for an arc distance of 30.01 feet to the TRUE POINT OF BEGINNING through which a radial line of said curve bears S. 45 °05'25" E., containing 0.004 acres of land, more or less. A.P. Number: 69- 27 -1 -3 (portion) The above - described property is located in the City of Alameda, County of Alameda, State of California. Section 2 . The Mayor of the City of Alameda is hereby authorized to execute, and the City Clerk to attest, a grant deed transferring the hereinbefore property to Ponderosa Homes, a Cali- fornia general partnership. -2- I, the undersigned, hereby certify that the foregoing Ordinance was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 20the of July, 1982, by the following vote to wit: AYES: Councilmen Diament, Gorman, Stone, and President Corica - 4.
