DETERMINING AND DECLARING THE NEED FOR THE COMMUNITY
IMPROVEMENT COMMISSION TO FUNCTION IN THE CITY OF
ALAMEDA AND DECLARING THE CITY COUNCIL OF THE CITY OF
ALAMEDA TO BE THE IMPROVEMENT COMMISSION
WHEREAS, the Council of the City of Alameda has determined
that there is a community need for a redevelopment agency in the
City of Alameda; and
WHEREAS, the Council of the City of Alameda does hereby so
declare that there is a need for a redevelopment agency to function
within the City of Alameda pursuant to the Health and Safety Code
of the State of California, Section 33000 et seq.;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF ALAMEDA that:
1. The City Council declares itself to be the Agency of
the City of Alameda pursuant to Section 33200 of the Health and
Safety Code and finds that such action will serve the public interest
and promote the public safety and welfare in an effective manner.
The City Council further declares that all of the rights, powers,
duties, privileges, and immunities of the said Law are vested in
the City Council.
2. The Agency created herein is designated as "The Community
Improvement Commission of the City of Alameda."
3. Inasmuch as the population of the City of Alameda is
less than 200000, compensation of the members of said Improvement
Commission is hereby established pursuant to Section 33114.5 of
the Health and Safety Code, as such section may be amended from
time to time. Provided, however, that no member shall receive
compensation for attending more than four meetings of the Commission
during any calendar month. In addition, members shall receive their
actual and necessary expenses incurred in the discharge of their
duties.
4. If any section, subsection, sentence, clause, or phrase
of this ordinance is for any reason held to be invalid, such
decision shall not affect the validity of the remaining portions
of this ordinance. The City Council hereby declares that it
should have adopted the ordinance and each section, subsection,
sentence, clause, or phrase thereof, irrespective of the fact that

any one or more sections, subsections, sentences, clauses, or
phrases be declared invalid.
5. This ordinance shall be in full force and effect from
and after the expiration of thirty (30) days from the date of its
final passage.

1, the undersigned, hereby certify that the foregoing Ordinance
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 3rd of August, 1982,
by the following vote to wit:
AYES: Councilmen Diament, Gorman, Stone, and President Corica - 4.
NOES: None.
ABSENT: Councilman Sherratt - 1.
