AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ALAMEDA, CALIFORNIA, AUTHORIZING AN
AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF
ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES'
RETIREMENT SYSTEM AND THE CITY OF ALAMEDA
(REQUIRES FOUR AFFIRMATIVE VOTES)
WHEREAS, due to ongoing economic difficulties, the City negotiated and
approved revised agreements with its sworn safety employees whereby all
0 sworn safety employee groups will contribute additional sums toward the
employer portion of their retirement contribution; and
WHEREAS, to effectuate this cost - sharing agreement under the State of
California Public Employee Retirement Law Section 20516, an amendment to the
contract between the City of Alameda and the California Public Employees'
Retirement System must be approved; and
WHEREAS, in accordance with the Charter Article III. Sec. 12, the
adoption of this Ordinance is necessary for the immediate protection of the
public peace, health and safety in that it is necessary for the immediate
preservation of public funds.
NOW, THEREFORE, the City Council of the City of Alameda does
hereby ordain as follows:
Section 1. The Recitals set forth above are true and correct and
incorporated herein.
Section 2. That an amendment to the contract between the City
Council of the City of Alameda and the Board of Administration, California
Public Employees' Retirement System is hereby authorized, a copy of said
amendment being attached hereto, marked Exhibit A, and by such reference
made a part hereof as though herein set out in full.
Section 3. The Mayor of the City of Alameda is hereby authorized,
empowered, and directed to execute said amendment for and on behalf of said
Agency.
Section 4. Effective Date. The City Council hereby declares, on the
basis of the findings set forth above, that an emergency exists and that this
Ordinance is necessary to preserve the public peace, health and safety.
Accordingly, this Ordinance is adopted as an urgency ordinance and shall take
effect and be in force immediately upon its introduction and adoption on
January 3, 2011.
Section 5. If any provision of this Ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect
other provisions or applications of this Ordinance which can be given effect
without the invalid provision or application, and to this end the provisions of this
Ordinance are severable. The City Council hereby declares that it would have
adopted this Ordinance irrespective of the invalidity of any particular portion
thereof.
Section 6. The City Clerk will certify to the passage of this Ordinance
by the City Council of the City of Alameda and a digest thereof shall be
published once in the Official Newspaper of the City within three days after its
adoption.
