Ordinance 3055CITY OF ALAMEDA ORDINANCE NO. 3055 New Series APPROVING A 20 -YEAR LEASE WITH AN OPTION FOR A 5 -YEAR EXTENSION BETWEEN THE CITY OF ALAMEDA AND GREENWAY GOLF ASSOCIATES, INC., FOR PREMISES LOCATED AT THE CHUCK CORICA GOLF COMPLEX WHEREAS, the City is owner of the real property commonly known as the Chuck Corica Golf Complex ( "Complex ") located at 1 Clubhouse Memorial Road, Alameda, California 94502; and WHEREAS, the City desires to lease the Complex to Greenway Golf Associates, Inc. ( "Greenway "), and Greenway is willing to accept the lease under mutually acceptable terms and conditions as set forth in the lease attached to the Staff Report; and WHEREAS, pursuant to City Charter Article XXII Section 12, the City Council, without requiring a public vote, may lease public park property which is defined to include the Complex; and WHEREAS, pursuant to City Charter Article III Section 10, no real property of the City shall be leased for a period in excess of one year except on the affirmative vote of four members of the City Council. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Alameda that: Section 1. The Lease is approved upon the affirmative vote of four members of the City Council. Section 2. The City Manager of the City of Alameda or his designee is hereby authorized to execute, for and on behalf of the City of Alameda, the Lease subject to such technical or clarifying revisions as are reasonably determined necessary by the City Manager and approved by the City Attorney, and the City Clerk is hereby authorized and directed to attest to the same. Section 3. The City Manager, or his designee, is hereby further authorized and directed to execute all documents or instruments as may be necessary or appropriate to carry out the provisions of the Lease on behalf of the City, including but not limited to amending exhibits and schedules to the Lease; provided, however, any material amendment to the Lease or the termination of the Lease must be approved by the City Council. Section 4. This ordinance shall be in full force and effect after the expiration of thirty (30) days from the date of its final passage.
