AUTHORIZING EXECUTION OF AGREEMENT FOR CONTRACT
ADMINISTRATION AND COORDINATION FOR PARK
IMPROVEMENTS AND PARK IMPROVEMENT FUNDS AS DEFINED
IN DEVELOPMENT AGREEMENT (DA) 89-1 AND THE PARK
MAINTENANCE AGREEMENT DATED APRIL 4, 1989
WHEREAS, on November 3, 1988, the Council of the City of
Alameda, per Resolution No. 11591, authorized the execution of a
Settlement Agreement with Harbor Bay Isle Associates, Harbor Bay
Village Four Associates, and Harbor Bay Village Five Associates;
and
WHEREAS, per Item 2C of said Agreement, the Park Improvement
and Maintenance Agreement which sets the timing, scope, and nature
of the improvements to and maintenance of the entire Tract 4500
shoreline was approved by the Council on April 4, 1989; and
WHEREAS, per Item 11E of said Agreement, the Development
Agreement for the revised plan for Village V was approved by the
Council on April 4, 1989; and
WHEREAS, Harbor Bay Isle Associates has agreed to provide
construction contract administration and coordination services for
public improvement to the Shoreline Park, Phases IIIA (located
adjacent to the Harbor Bay Parkway portion of the Business Park,
from just westerly of North Loop Road to the eastern boundary of
the Shoreline Park), Phase IIIB (located within the Business Park
just east of Mecartney Road extension to Phase IIIA), and Phase IV
(located adjacent to the residential development of Village V, west
of the Mecartney Road extension and east of Village IV);
WHEREAS, based upon the Park Improvement and Maintenance
Agreement, the estimated cost for construction and installation of
improvements to the Shoreline Park is $1,850,000 with compensation
requested being $59,194.78 or approximately 3.2% of the total
costs;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that the Mayor and the City Clerk be, and each hereby is,
authorized and directed to execute and to attest to, respectively,
on behalf of the City, an agreement for contract administration
and coordination for improvements to Shoreline Park, Phase IIIA,
IIIB, and IV, and park improvement funds as defined in Development
Agreement (DA) 89-1 and the Park Maintenance Agreement dated April
4, 1989.

was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 21st of
November, 1989, by the following vote to wit:

NOES: Councilmember Thomas - 1.
ABSENT: Councilmen er Camicia - 1.
ABSTENTIONS: None.
