ORDERING THE VACATION OF PORTIONS OF A PUBLIC
ACCESS/OPEN SPACE EASEMENT LOCATED WITHIN
LOT 2 TRACT 6096 (ALAMEDA MARINA VILLAGE
PACIFIC MARINA)
WHEREAS, the City Council of the City of Alameda approved
the final map for Tract 6096 on August 15, 1989; and
WHEREAS, on October 11, 1989, an easement was recorded
which was granted by Alameda Real Estate Investment and accepted
on behalf of the City of Alameda in connection with public
access/open space, established on the Final Map for Tract 6096
(Alameda Marina Village Pacific Marina); and
WHEREAS, subsequent to recording of Final Map for Tract
6096, the exact location of the Marina Village Inn expansion
building has been determined to slightly overlap portions of the
subject easement; and
WHEREAS, the Engineering Division and Planning Department
have determined that the revised building expansion plan will
affect only a minimal amount of the subject easement, and that the
remaining easement will adequately provide public access; and
WHEREAS, a legal description describing the portions of
easement proposed to be vacated is attached hereto as Exhibit A,
and a plat map is on file with the City Clerk;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that:
(1) It is hereby found and determined that the portions
of the easement described in Exhibit A are unnecessary for present
or prospective public use and have been superseded by relocation,
and there are no public facilities located thereon.
(2) It is hereby ordered that the portions of the public
access/open space easement located within Lot 2, Tract 6096, as
described in Exhibit A attached, are hereby vacated pursuant to the
provisions of Chapter 4, Part 3, Division 9, of the California
Streets and Highways Code, and particularly Section 8333 thereof;
BE IT FURTHER RESOLVED that the City Clerk shall cause
i certified copies of this order, attested under seal, to be recorded
in the County Recorders Office and from and after the date this
resolution is recorded, said portions of the public access/open
":---4>space easement no longer shall constitute easements.

City of Alameda in regular meeting assembled on the 6th day of
