ACCEPTING GRANT OF EASEMENT FROM HARBOR BAY
ISLE VILLAGE FIVE ASSOCIATES TO CITY OF
ALAMEDA FOR ADDITIONAL RIGHT-OF-WAY FOR
MECARTNEY ROAD.
WHEREAS, Condition K (3), MeCartney Road, of City of Alameda
Resolution # 11691 approved on April 4, 1989, required that the
cul-de-sac proposed for the termination of MeCartney Road be
redesigned to the satisfaction of the City Engineer to accommodate
traffic into Neighborhoods A and B, access to the ferry terminal
parking area, and potential public transportation; and
WHEREAS, such redesign requires additional right-of-way; and
WHEREAS, the City Engineer has reviewed the redesigned
termination of MeCartney Road and finds its satisfactory; and
WHEREAS, Harbor Bay Isle Five Associates has offered to
transfer title of said additional right-of-way to the City of
Alameda; and
WHEREAS, Harbor Bay Isle Five Associates have prepared a legal
description of the additional right-of-way; and
WHEREAS, the City Engineer has reviewed the description and
finds it satisfactory;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that the additional right-of-way for MeCartney Road
described in the attached Grant Deed is hereby accepted on behalf
of the City of Alameda for use in conformity with the terms of the
Grant Deed.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to record such deed.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in adjourned regular meeting assembled on the
7th day of June , 1990, by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Thomas, Withrow
and President Corica - 5,
NOES: None.
ABSENT: None,
ABSTENTIONS: None.

EXHIBIT "B"
GRANTOR hereby reserves as assignable easement in gross for the
installation, construction, reconstruction, maintenance, repair,
operation and use of one or more underground conduits, pipes,
valves, controls and manholes as well as underground and above-
ground pumps, fixture's and appurtenances necessary to any and all
thereof, for the purpose of transportation and distribution of
irrigation water to and from points within said parcel, as well as
to and from points beyond said parcel, under, on and over all
public streets.
AND, said Grantor hereby reserves an assignable easement in gross
for the installation, construction, reconstruction, maintenance,
repair, operation and use of one or more underground conduits,
service boxes, wires, cables and other electrical and optical
conductor, as well as underground and above - ground fixtures and
appurtenances necessary to any and all thereof for the purpose of
transmission and distribution of private communications signals to
and from points within said parcel as well as to and from points
beyond said parcel. Said reservation shall be separate and
distinct from and not confused with conduit installed for purposes
of providing CATV and related signals and services in Alameda,
Additional conduit will be installed compatible with CATV conduit
already installed on other portions of Bay Farm Island for the
City's use which will not be subject to this reservation,
AND, said Grantor of said community communications systems and/or
said transportation and distribution of irrigation water systems
shall obtain a permit from the City Engineer prior to any
construction, alterations, or maintenance work on their systems
within said right -of -way, the design and specific location of such
installation being subject to the approval of the City Engineer,
Approval of the work covered by the City Engineer's permit shall
be based on the same standards and conditions as would be required
of Public Utilities or contractors doing work in the City of
Alameda.
