Resolution 11995CITY OF ALAMEDA RESOLUTION NO. 11995 APPROVING DIVISION OF PROPERTY LOCATED AT 3256 AND 3258 BRIGGS AVENUE AND GRANTING A WAIVER OF THE REQUIREMENT OF A PARCEL MAP. WHEREAS, the property located at 3256 and 3258 Briggs Avenue is 50 feet wide and 203 feet deep and is currently a single, legal lot; and WHEREAS, the property owner proposes to divide the property into two parcels; and WHEREAS, the property owner has requested the City Council to waive the Parcel Map requirement; and WHEREAS Section 11 -316.5 of the Alameda Municipal Code permits council to waive a parcel map if certain findings are made. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the City Council finds the proposed division of property complies with the requirements of the City Subdivision Ordinance and state law as to: (a) (b) (c) (d) (e) (f) (g) (h) Area; Improvements and design; Drainage; Improved public roads; Sanitary facilities, provided letter of credit guaranteeing sewer lateral to serve Parcel Water supply; Environmental protection; and that No public improvements will be necessary a consequence of the proposed division; a suitable cash deposit or installation of a sanitary A is provided to the City; or desirable as BE IT FURTHER RESOLVED that the Council of the City of Alameda approves the proposed division of the property located at 3256 and 3258 Briggs Avenue into two parcels, Parcel A and Parcel B, the legal description of which is attached hereto as Exhibit A and B, respectively. BE IT FURTHER RESOLVED that the Council of the City of Alameda hereby waives the requirement of a Parcel Map for this property division. 0 PARCEL A Those parcels of land in the City of Alameda, County of Alameda, State of California, described as follows: PARCEL ONE: A portion of Lot 31, Map of the Briggs Tract, filed September 8, 1884, Map Book 6, page 27, Alameda County Records, described as follows: Beginning on the southeastern line of said Lot 31 distant thereon S 42° 11' 10" W, 103 feet from the most eastern corner thereof; thence from said point of beginning N 47° 42' 50" W, 50 feet to the northwestern line of said Lot 31; thence along the exterior lines of said Lot 31 as follows: S 42° 11' 10" W, 100 feet; S 47° 42° 50" E, 50 feet; and N 42° 11' 10" E, 100 feet to the point of beginning. PARCEL TWO: A non-exclusive easement appurtenant to Parcel One above for access and utility purposes over the following described strip of land: A portion of Lot 31, Map of the Briggs Tract, filed September 8, 1884, Map Book 6, page 27, Alameda County Records, described as follows: Beginning on the southeastern line of said Lot 31 distant thereon S 42° 11' 10" W, 103 feet from the most eastern corner thereof; thence from said point of beginning N 47° 42' 50" W, 10 feet, thence N 42° 11' 10" E, 103 feet to the northeastern line of said Lot 31; thence along the northeastern and southeastern lines of said Lot 31, S 47° 42° 50" E, 10 feet and S 42° 11' 10° W, 103 feet to the point of beginning. PARCEL B That parcel of land in the City of Alameda, County of Alameda, State of California, described as follows: A portion of Lot 31, Map of the Briggs Tract, filed September 8, 1884, Map Book 6, page 27, Alameda County Records, described as follows: Beginning on the southeastern line of said Lot 31 distant thereon S 42° 11' 10" W, 103 feet from the most eastern corner thereof; thence from said point of beginning N 47° 42° 50" W, 50 feet to the northwestern line of said Lot 31; thence along the exterior lines of said Lot 31 as follows: N 42° 11' 10' E, 103 feet; S 47° 42' 50" E, 50 feet; and S 42° 11' 10" W, 103 feet to the point of beginning. RESERVING THEREFROM: A non-exclusive easement appurtenant to the remainder of said Lot 31 for access and utility purposes over the south- eastern 10 feet thereof.
