Resolution 11996CITY OF ALAMEDA RESOLUTION NO. 11996 GRANTING A NOISE MONITORING FACILITY EASEMENT TO THE CITY OF OAKLAND (PORT OF OAKLAND) WHEREAS, the Port of Oakland has identified two sites on property owned by the City of Alameda which it has requested for use for purposes of aircraft noise monitoring, the City-owned properties being the extension of Central Avenue easterly of Eastshore Drive within the existing public right-of-way, (Noise Monitoring Terminal No. 3), and an area in Godfrey Park at the end of Seminary Avenue; (Noise Monitoring Terminal No. 4); and WHEREAS, the Port is prepared to install an automated aircraft noise monitoring system to be able to respond to State mandates for determining the location of noise impact boundaries; identifying especially noise aircraft or those deviating from established noise abatement procedures, and for providing data to support resolution of noise complaints; and WHEREAS, the Port has agreed to provide regular quarterly reports generated by this new equipment and to provide information upon request on incidents of non-compliance; and WHEREAS, the first site was selected to assist in noise complaint resolution, and to help track compliance with general aviation noise abatement departure procedures; and WHEREAS, the second site was selected to help provide data to locate the 65db CNEL contour for North Field operations, and to provide useful data for noise produced during South Field take offs; and WHEREAS, legal descriptions describing the Noise Monitoring Facility Easements proposed are attached hereto as Exhibit A and B. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that: (1) The cost to lease/purchase the noise monitoring equipment is solely the responsibility of the Port. The Port has agreed to make reports produced by the equipment available to the City quarterly and upon request. (2) The consideration for granting the easement is City access to the noise monitoring information to help keep 1" airport/aircraft generated noise at acceptable levels and td't.';' identify those who fail to comply with airport noise abatementi:—t procedures. ;Th 0 BE IT FURTHER RESOLVED that the City Council of the City of Alameda grants the Noise Monitoring Easement described in Exhibit A to the City of Oakland, acting through its Board of Port Commissioners. BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and each hereby is, authorized and directed to execute and to attest to, respectively, on behalf of the City of Alameda, a grant of said easement to the City of Oakland, acting through its Board of Port of Commissioners. 1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 7th day of August , 1990, by the following vote to wit: AYES: NOES: Councilmembers Arnerich, Camicia, Thomas, Withrow and President Corica - 5.
