AUTHORIZING APPLICATION TO THE PUBLIC UTILITIES
COMMISSION OF THE STATE OF CALIFORNIA TO CONSTRUCT A
PUBLIC ROADWAY ACROSS THE RIGHT -OF -WAY OF THE ALAMEDA
BELT LINE RAILROAD TO FACILITATE THE EXTENSION OF SHERMAN
STREET NORTH FROM EAGLE AVENUE TO THE SOUTHERN TERMINUS
OF ATLANTIC AVENUE
WHEREAS, a private roadway easement exists across Alameda
Belt Line railroad property between the northern terminus of
Sherman Street north of Eagle Avenue and the easterly terminus of
Atlantic Avenue at the Alameda Marina Village development boundary;
and
WHEREAS, there are three actively used railroad crossing
controlled by vehicular stops signs on each side of the railroad
tracks; and
WHEREAS, the subject roadway is identified as a major
access for the Marina Village development, and all improvements
adjacent to this private roadway, including construction of
Atlantic Avenue and signalization at the intersection of Sherman
Street and Buena Vista Avenue are now complete; and
WHEREAS,
the Alameda Belt
proposed roadway
improvements, and
the City has reached a tentative agreement with
Line and Santa Fe Railroad which defines the
alignment, necessary right -of -way, roadway
crossing control devises required.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that it does hereby authorize application to the Public
Utilities Commission of the State of California to construct a
public roadway, across the right -of -way of the Alameda Belt Line
Railroad to facilitate the extension of Sherman Street, north from
Eagle Avenue to the easterly terminus of Atlantic, and designate
the Public Works Director to act on behalf of the City in all
matters relating thereto.
BE IT FURTHER RESOLVED by the Council of the City o
Alameda that:
1. All proposed modifications to railroad crossings:
must be approved by the Public Utilities Commission of the State
of California (P.U.C.).
2. The City of Alameda will make necessary application<
to the P.U.C. and that final approval of the proposed modifications
and improvements is contingent on receiving approval from the
P.U.C.
BE IT FURTHER RESOLVED that the project will be financed
in part from Gas Tax Funds, a State Grant under the 203 Program,
developer contributions from Alameda Real Estate Investments
(Assessment District 89-1), Paragon Group, future developers of the
drive-in theater, and in part by the Alameda Belt Line.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 21st day of
August , 1990, by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Thomas, Withrow
and President Corica - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
