Resolution 12003CITY OF ALAMEDA RESOLUTION NO. 12003 AUTHORIZING THE DESTRUCTION OF CERTAIN POLICE DEPARTMENT RECORDS WHEREAS, Government Code Section 34090 et seq. authorizes City Department Heads to destroy those City records, documents, instruments, books or papers after the same are no longer required with the approval of the Legislative Body by Resolution, and the written consent of the City Attorney; and WHEREAS, the City Attorney by memorandum of July 18, 1990 has consented to the destruction of those records, documents, books or papers described in Exhibit A attached; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that it does hereby authorize the Police Department to destroy the City records, documents, books or papers under herm charge as described in Exhibit B, attached hereto and made a part hereof. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 21st day of August , 1990, by the following vote to wit: AYES: Councilmembers Arnerich, Camicia, Thomas, Withrow and President Corica - 5. Korade City Attorney RE: Destruction of Records In response to your memo of June 22, 1990, seeking to destroy Police Personnel Records, you now have my approval for the destruction of the following: 1. All Personnel records for police officers, police technicians, and civilian employees terminated, resigned or retired for over ten (10) years. 2. Personnel records for police officers terminated, resigned, or retired for over five (5) years, not to include complaints, accidents, injuries, or Pitchess Motions. 3. Personnel records for police technicians and other civilian employees terminated, resigned, or retired for over two (2) years. This would not include files on complaints, accidents, injuries, or Pitchess Motions. 4. Background investigation files on personnel not hired and over five (5) years old. This approval is granted pursuant to California Government Code Section 34090 (Deering, 1989). If you need anything further, please let me know. cc: Chief R. Shielis L. Kingsley W.
