APPROVING PARCEL MAP 5984 LOCATED AT 1226/1228 REGENT
STREET SUBJECT TO CERTAIN CONDITIONS AND GRANTING AN
EXCEPTION FROM SECTION 11-3118.1 OF THE SUBDIVISION
ORDINANCE REQUIRING UNDERGROUNDING OF UTILITIES
WHEREAS, the owner and subdivider herein, has presented
to the City Council for approval of Parcel Map 5984 to subdivide
a division of property located at 1226/1228 Regent Street; and
WHEREAS, Parcel Map 5984 was approved by the City of
Alameda Planning Board on September 11, 1990, by Resolution No.
2099; and
WHEREAS, Parcel Map 5984 was found to be in conformance
with the City's Combined Land Use Plan (CLUP), and it has been
determined that there would be no significant environmental impact
from the proposed subdivision; and
WHEREAS, Parcel Map 5984 is categorically exempt pursuant
to Section 15315 of the California Environmental Quality Act (CEQA)
Guidelines; and
WHEREAS, the subdivider has requested an exception from
Subdivision Ordinance Section 11-3118.1 which requires that all
utilities be placed underground, and the Engineering Department has
reviewed this request and finds it agreeable, and
WHEREAS, A $7,404 deposit has been provided by the
subdivider to guarantee planting trees, reconstructing curbs,
installing sewer cleanouts, installing and testing sewer laterals,
and providing a mylar copy of the recorded map to the City
Engineer.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda, by resolution, approve Parcel Map No. 5984, subject to
the conditions contained in Planning Board Resolution No. 2099,
modified as follows:
1. Condition 5 shall be revised to read as follows: "At the
time of any redevelopment or change in use of the subject2!
property, the site drainage shall be modified to comply
with City design standards."
2. Condition 12 shall be revised to read as follows: "At
the time of any addition to any existing structure on
Parcel 2 or construction of any new structure on Parcel
2, a 20-foot wide access road shall be constructed to
serve Parcel 2 or automatic fire sprinkler systems shall
be installed in structures."
BE IT FURTHER RESOLVED by the Council of the City of
Alameda that the requested exception to Section 11-3118.1 of the
City of Alameda Subdivision Ordinance is hereby granted.
BE IT FURTHER RESOLVED by the Council of the City of
Alameda that a Certified Copy of this Resolution shall be recorded
simultaneously with Parcel Map 5984.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in adjourned regular
meeting assembled on the 7th of November, 1990
by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Thomas, Withrow
and President Corica - 5.
NOES: None.
ABSENT: None.
