VACATING A PORTION OF ALAMEDA AVENUE WEST OF OAK STREET
WHEREAS, on October 16, 1990, the City Council, by
Resolution No 12025 stated an intention to vacate a portion of
Alameda Avenue west of Oak Street, and
WHEREAS, the vacation proceeding has been conducted
pursuant to the provisions of the California Streets and Highways
Code, Chapter 3, Division 9, Part 3, (General Vacation Procedures),
and a public hearing held; and
WHEREAS, a tentative agreement between the Alameda
Unified School District and the City of Alameda has been drafted
which describes the terms of the street vacation and subsequent
transfer of property; and
WHEREAS, utility companies have been notified of the
proposed vacation and are making plans to relinquish ownership or
to relocate facilities to minimize any need for utility easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Alameda hereby approves the vacation of the subject
portion of Alameda Avenue, described hereto as Exhibit A, on the
following terms and conditions:
(1) The City of Alameda will reserve any easement
required by the utility companies to satisfy their present o
future needs.
(2) The vacation shall be effective only after the sale
of the subject portion of Alameda Avenue to the Alameda Unified
School District District is finalized and conditions have been satisfied.
BE IT FURTHER RESOLVED that the City Clerk shall cause
a certified copy of this resolution of vacation, attested under
seal, to be recorded in the County Recorders Office once the
vacation is effective.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the fourth day of
December, 1990, by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Thomas,
Withrow and President Corica - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
IN WITNESS, WHEREOF, I have hereunto set my hand and affixed the

VACATION OF ALAMEDA AVENUE WEST OF OAK STREET
An improved portion of a public street, situate in the City
of Alameda, County of Alameda, State of California, described as
follows:
Being a portion of Alameda Avenue, as shown on the "Map of
Lands Adjacent to the Town of Encinal," as surveyed by Jas. T.
Stratton; filed May 28, 1867, in Book 19 of Maps, page 53, in the
Office of the Alameda County Recorder; and further described as
follows:
All that portion of Alameda Avenue (60 feet wide and
241.92 feet long) lying between that portion of said
Alameda Avenue vacated by the City Council of the
City by their Resolution No. 8400, adopted August 19,
1975 (recorded-August 21, 1975 on Reel 4074, Image
75, in the Office of the Alameda County Recorder),
and, the northwestern right -of -way line of Oak Street
(60 feet wide, as the same now exists).
