VACATING A PORTION OF BUENA VISTA AVENUE AND WEBSTER
STREET INTERSECTION, ACCEPTING A FOUR -FOOT STRIP OF
CHEVRON U.S.A. PROPERTY ALONG THE EAST SIDE OF WEBSTER
STREET, AND APPROVING AN AGREEMENT GUARANTEEING
CONSTRUCTION OF THE INTERSECTION.
WHEREAS, Chevron U.S.A. Inc. has requested a portion of
intersection to be vacated at the southwest corner of their
existing facility located on Buena Vista Avenue and Webster Street;
and
WHEREAS, the Zoning Administrator approved the required
variance (V -90 -8) for three driveways, with the condition that
required Chevron U.S.A., Inc., to dedicate a four -foot strip of
frontage along Webster Street for future widening of Webster
Street, in return the City will dedicate surplus property at the
northeast corner of Webster Street and Buena Vista Avenue to
Chevron, U.S.A., Inc.; and
WHEREAS, the City Attorney's Office has developed
quitclaim deeds for each transfer, and the Engineering Division has
approved the survey plat and legal descriptions for the proposed
property exchange.
WHEREAS, Chevron U.S.A., Inc., has guaranteed the
completion of future intersection modifications as required by the
City.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that the City Council, by resolution, authorize the
vacation of the subject portion of Buena Vista Avenue and Webster
Street intersection, accept dedication of a four -foot wide strip
of Chevron U.S.A. Inc. property along the east side of Webster
Street, and approve the guarantee amount of $35,000.
BE IT FURTHER RESOLVED by the Council of the City of
Alameda that the City Council, by motion, authorize execution of
the agreement between the City of Alameda and Chevron U.S.A., Inc.,
guaranteeing construction of the subject intersection.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the eighteenth
day of December, 1990, by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Thomas,
Withrow and President Corica - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
