ACCEPTING AND APPROVING GRANT OF EASEMENT AND ASSIGNMENT
OF PERMITS AND ENABLING AGREEMENTS FOR PUBLIC MARINE
TRANSPORTATION TERMINAL FACILITY, LOCATED ON HARBOR BAY
ISLE.
WHEREAS, the City Council at the September 4, 1990 City
Council meeting approved the Negative Declaration, Use Permit and
Final Development Plan for the proposed Harbor Bay Isle Ferry
Terminal, Resolution No. 12014; and

WHEREAS, in accordance with Section 3-10 of the City
transfer for a period longer than one year of real
or any interest therein may be authorized by resolution;
WHEREAS, the Grant of Easement has been reviewed and
by the City of Alameda's bond counsel firm, Jones Hall
White; and
WHEREAS, the method of transferring the property to the
City is consistent with the established method of dedications of
other Harbor Bay property to the City for public purposes; and
WHEREAS, the Grant of Easement provides a framework for
the assignment of a License Agreement with the Port of Oakland and
permits from San Francisco Bay Conservation Development Commission
(BCDC) and the U.S. Army Corps of Engineers; and
WHEREAS, the proposed easements are as follows:
1. A 1.65 acre parcel to be used for parking adj
to the Harbor Bay Isle ferry.
2. A 0.1349 acre parcel for the terminal buildin
3. A 1.043 acre parcel for access and parking.

4. An easement and right-of-way across the Shoreline
Park for access to the ferry dock.
5. Easements and right-of-way to provide a 25-foot wide
access to and from the ferry parking and terminal
facility from the westerly terminus of Harbor Bay
Parkway; and
WHEREAS, the Grant of Easement makes the Harbor Bay ferry
terminal site a public facility which qualifies for the use of
public (Assessment District) funds for construction.
WHEREAS, the Council may by resolution authorize the
acquisition of property when there is no cost to the City; and
WHEREAS, there is no cost to the City associated with the
acquisition of the easements because of the related agreement with
Harbor Bay Business Park Association.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the City Council, by resolution, accept and approve
the grant of easement and assignment of permits and enabling
agreements for Public Marine Transportation Terminal Facility
located on Harbor Bay Isle, a copy of which is on file with the
City Clerk.
BE IT FURTHER RESOLVED that the maintenance of the
facilities will be financed through the Island City Landscaping and
Lighting Maintenance District 84 -2.

was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 18th day of
