APPROVING SUBMITTAL OF A REVISED PROPOSITION 85 APPLICATION
AND CERTIFYING NEW ALAMEDA LIBRARY PROJECT BUDGET, LOCAL
MATCHING FUNDING COMMITMENT, SUPPLEMENTAL FUNDS, AND THE
APPLICATION FOR FUNDS FROM THE LIBRARY CONSTRUCTION AND
RENOVATION BOND ACT FUND OF 1988 (PROPOSITION 85), AND
APPROVING THE RECORDING OF THE STATE'S INTEREST IN THE TITLE
OF RECORD FOR THE PROPOSED SITE
WHEREAS, the Library Board and the City Council have
agreed that the Main Library facility is inadequate for present
use; and
WHEREAS, the public library is a supplement to the formal
system of free public education, a source of information and
inspiration to persons of all ages, races, and economic
backgrounds, a resource for continuing education and re-education
beyond the years of formal education, and needs to be preserved and
maintained and therefore deserves adequate financial support from
governments of all levels; and
WHEREAS, the City of Alameda commits to operate and
provide direct public library services; and
WHEREAS, the California Library Construction and
Renovation Bond Act of 1988 (Proposition 85) creates a grant
program to construct and renovate local public libraries; and
WHEREAS, Proposition 85 provides 65% in state funding
for library construction and'renovation; and
WHEREAS, Community Facilities District #1 (CFD #1) has
been determined to have impacted citywide library needs to an
amount computed to be $500,000; and
WHEREAS, $500,000 of Community Facilities District #
funds are being contributed to citywide library needs; and
WHEREAS, the California State Library has received
approval from the Office of Administration Law (OAL) of the Title
5 regulations for the Library Bond Act program; and
WHEREAS, said adopted procedures established by the
California State Library require the applicant to certify by
resolution the approval of applications prior to submission of said
applications to the State; and
WHEREAS, the City Council took action on this resolution
at an open public meeting;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that said Council hereby certifies and declares the
foregoing recitals are true and correct.
BE IT FURTHER RESOLVED that the City Council hereby
certifies the following:
1. The Project Budget set forth in the City's
application and application form section entitled
"Library Project Budget" for the Proposition 85
funds is the correct estimated amount required for
the construction of the new Alameda Library. The
project budget includes all expenditures for
eligible project costs, as well as any other capital
outlay expenditures directly related to the library
construction project. All funding sources including
state matching, local matching, and local
supplemental funding are shown.
2. To match the amount of $9,315,252 which is requested
of the California State Library, local matching
funds are committed in a total amount of $5,015,905,
which is 35% of the total eligible project costs.
The local matching funds are comprised of $2,151,255
to be made available from City resources and
$2,864,650 provided as land credit for the new
library site.
3. The City has the ability to finance $1,082,873 in
supplemental funds necessary to complete the project
in a timely manner.
4. The City guarantees that the required local matching
funds and supplemental funds necessary to complete
the library project at the level stated in the
project budget will be made available in a timely
manner.
5. All information contained in the application form
is true and accurate.
6. The City is committed to operating the completed
library facility and to providing direct public
library service.
BE IT FURTHER RESOLVED by the Council of the City of
Alameda that when state grant funds have been provided by the
California Library Construction and Renovation Board for
acquisition of or credit for land, the City of Alameda shall record
in the title record the state's interest in the land upon
completion of said project. As specified in Education Code section
19967, the title record for the land for the project shall specify
the state's interest by recording that the land shall be used to
provide direct public library service for twenty years following
the completion date of said project or the useful life of the
library building in place upon it, whichever is longer.
BE IT FURTHER RESOLVED by the Council of the City of
Alameda that when state grant funds have been provided by the
California Library Construction and Renovation Board for
construction of a library facility, the City of Alameda shall
record in the title record the state's interest in the facility
upon completion of said project. As specified in Education Code
section 19967, the title record for the building shall specify the
state's interest by recording that the library facility shall be
used to provide direct public library service for twenty years
following the completion date of said project or the useful life
of the library building in place upon it, whichever is longer. •
BE IT FURTHER RESOLVED that the City Council has
previously approved the project subject to the award of funds from
the Library Construction and Renovation Bond Act Fund of 1988
(Proposition 85).
BE IT FURTHER RESOLVED that the City Council hereby
appoints the City Manager or'his designee to coordinate, process,
and execute all contracts, agreements, amendments, and ancillary
documents within the scope of the attached application, including
recordation of the state's interest in the land and building as
specified above, except that the Mayor shall sign the application.
BE IT FURTHER RESOLVED that a copy of this resolution
shall be submitted with the City's application prior to the State
Librarian's deadline for applications.
BE IT FURTHER RESOLVED that the Mayor shall sign a copy
of this resolution certifying the accuracy and truthfulness of the
information provided during the application for state funds and the
City Clerk shall notarize or validate this resolution by affixing
the official seal of the City Clerk.
BE IT FURTHER RESOLVED that this resolution shall be duly
recorded in the minutes of the meeting at which it was passed.
