ADJUSTING THE POLICE AND FIRE FEE REQUIREMENTS
AS REQUIRED BY CHAPTER 2, TITLE XX OF THE ALAMEDA MUNICIPAL CODE
WHEREAS, the City Council of the City of Alameda
commissioned a report entitled "Police /Fire Fee Technical Report"
to provide the methodology for determining the formula, the fee,
and the reasonable relationship between the fee requirements and
the types of development subject to the City's police and fire fee
requirements. The report examined the connection between
development with an emphasis on new development. The report
concluded that a clear nexus can be established between the amount
of new development and the need for increased police and fire
services; and
WHEREAS, the City Council has reviewed the report and
concluded that certain facilities and related equipment will be
required to provide adequate police and fire services at buildout
and that buildout will add approximately 16.34 million square feet;

O WHEREAS, an annual review is required by Chapter 2, Title
- XX of the Alameda Municipal Code and the City Council has conducted
such a review; and
WHEREAS, the City Council then concluded that the share
of required police and fire services attributable to new square
footage should be adjusted to $0.14 per square footage; and
WHEREAS, the police and fire fee amounts may be
approximate; and
WHEREAS, the police and fire fee requirements provide
the formula for determining the amount of the fee to be provided,
the cost and beneficiaries thereof, the relationship between this
requirement and the various types of new and expanded developments,
and the time for paying such fee.
NOW, THEREFORE, BUT IT RESOLVED by the Council of the
City of Alameda that in accordance with Chapter 2, Title XX of the
Alameda Municipal Code and with the above statements, the
requirements are hereby adjusted for the Police and Fire Fee
requirements for new construction.
Police and Fire Fee Requirements
The Police and Fire Fee requirements are based on the
estimated cost of providing police and fire service to new
construction. Fee requirements are based on the estimated cost of
providing facilities and equipment for the City of Alameda at
buildout and the percentage of new construction contributing to
buildout.
Definitions: For the purpose of this Resolution, the
following definitions shall apply.
A. "City Manager" is the City Manager or his /her designee.
B. "New Construction" is any construction which creates square
footage or adds square footage to an existing building or
structure which is subject to this section.
C. "Square feet" is the area included within the surrounding
walls of the new construction as determined by the City
Manager.
General Application
The requirements of this resolution apply to new construction.
Police and Fire Fee Requirement
Payment of Police and Fire Fee: The Police and Fire Fee
shall be paid on or before the final inspection date of the new
construction or date the certificate of occupancy is issued
whichever occurs first.
Calculation of Police and Fire Fee: The amount of the
Police and Fire Fee due for a new construction shall be calculated
as follows:
(Added square feet of new construction) x ($0.14 per
square foot) = Police and Fire Fee.
No fees are required for an interior remodel which merely
changes the use of the development and does not add square footage.
Use and Disbursement of Monies in the Fund: Monies in
the Police and Fire Fee Fund shall be used in accordance with and
in support of activities to implement the City's report prepared
by Economic and Planning Systems entitled "Police /Fire Fee
Technical Report ". Projects include additional Police and Fire
facilities, vehicles and equipment.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the Council of
the City of Alameda that the forgoing provisions of this resolution
amend Resolution No. 11939 and shall be effective immediately after
enactment of the City Council.

Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the sixth day of August, 1991.
