DECLARING CEPTAIK TREES ON THE CORNER OF FOUNTAIN
AND JACKSON STREETS TO PE A PUBLIC NUISAECE.
WHEREAS, a petition -signed by twenty-five residents in the neighborhood
of Fountain and Jackson Streets was received by the council of the City of Alameda
at its regular meeting held October 2, 1923, requesting the council to take measures
for removing or causing certain large eucalyptus trees growing on the southwest corner
of said streets to be removed, on the ground that they constituted a menace to life,
AND 'WHEREAS', the council has had said trees examined by Mr. A. C. Benton,
the Park Superintendent of said city, who has. reported that he has examined the same
and considers said trees to be dangerous and a menace to life and property as well as
a public nuisance,
AND WHMEAS, Miss Kate Lawrence, the owner of the said property, was noti-
fied to appear before the city council at its regular meeting held this Tuesday even-
ing, October,16, 1923, and show cause, if any she has, why said trees should not be
condemned as a public nuisance, and. the council having accorded said ollner a hearing
and having considered all the facto in the premises, now therefore
IT IS HEREBY RESOLVED', that the existence of said trees be, and they are
hereby deelared to be a public nuisance and a menace to life and property, and the
health officer of the 04ty of Alameda is hereby directed to notify said owner in
writing, pursuant to the provisions of Section 373a of the Renal Coe, to abate said
nuisance under penalty of being guilty of a misdemeanor and punishable accordingly.
I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly introduced and adopted by the Ceuncil of the City of Alameda in regular
meeting assembled on the 16th day' of October, 1923, by the following vote, tc wit:
AYES: Councilmen Adams, Tilden and President Otis, (3).
NOES: None.
ABSENT: Councilmen Latham and Ibrobst, (2) .
