WEEBEAS khe City Council of the Oity of Alameda. aia on the 16th day of
September, inS4, pass its Resolution of intention No. 73, N. S., to order the here-
rnafter described work. to be done and improvhment to be made an said city, which
Resolution. of intention was duly legally published as required by law. as appears
from the affiehvit of E. Ekwin arane, nnw on file in the office of the clerk of said
city; and whereas, notices of the passage of said Resolution of intention No. 73, N. S.,
headhd "Nhtice of Improvement" were duly and legally posted along the line of said
conet(stelated work and immrovement and in front of ail. the property liahle to be as-
sessed therefor, end on and along each and every open street and highway in the
assessment district dhscribed in said Resolution of intention, in time, form. manner
end number as rectrired by law, after the passage of said Resolution of Intention, as
appears from the affidavit of deorge Sperbeck, who personally posted the same, and who,
use/. the comwietion of the posting of said, notices, forthwith filed said affidavit in
the office of the clerii, enddiMag oath that he coawleted the posting of said notices on
the 25th day of Scptembers 19251 and whereon, ell protests cr objections presented.

described and the City Council of the City. of Alameda hereby orders the followkng work

That Say Island Avenue between the westerly line of Parh Street and the westerly
line of 'dark Avenue, in said city be graded; also that concrete curbs, gutters, gutter
bridges, sidewalks and corrugated iron culverts be constructed thereon of the dimensions
and at the locations shown on the plans and specifications hereinafter referred to; also
that said portion of Bay Island Avenue be paved in the roadway thereof with a six-inch
oiled Macadam .avement.
All of said or shall be done in accordance with the plans and specifications
adopted therefor and now on file in the office of the city clerk.
And Whereas, said contemplated. Tor':: end. improvement is, in the opinion of said
City Council, of more than local or ordinary pnblic benefit, said council hereby mak:es
the cost and expenses of said work and improvement chargeable upon a district, which
district said council hereby declares to be the district benefited by said work at im-
provement, and to be assessed to pay the costs and expenses thereof, which district is
bounded and described as follows.
Commencing at the intersection of Inc northerly line of Bay Island Avenue, with
the westerly line of Park Avenue, (as the same now exists) and running thence northerly
along. Inc westerly line of PaT Avenue, 25 feet, to a. point; thence westerly and parallel
with the northerly .lina of Bay Island Avenue, to a point on the easterly line of "Park
Street; thence sowther17 along the easterly lihe of Park Street to s point 25 feet, south-
erly fror the southerly line of Bay Island Avenue; thence easterly and parallel with. the
sohtherly lioe of Bay Island Avenne, to a point eh the westerly line of Par,. Avenue; thence
northerly along. the westerly line of Park Avenue; to the northerly linh of Bey island Avenue,
and the point of commancement; provided
The City Council hereby orders, and it is hereby resolved, that the coot and ex-
penses of that tart of the above described work lying and Icing 011 tte street intersection
between the lines aforementioned be paid for out of the general fund of the treasury of
said city.
The City Clerk is hereby instructed to post a notice of said worI, together with
the clans and specifications therefor, conspieunusly for five day on or near the council
chamber door, of said council inviting sealed proposals or bids for doing the rork ordered.
Said clerk ia also directed to publish twice, a notice itvitik,g such proposals, and re-
ferring to the specifications posted or on file, in the Alameda Times-Star, a daily news-
paper published and circulated in said city and hereby designated for that purpose.
All prorosals or bids shall to accompanied by a check payable to the City of
Alameda, certified by a restonsible bank for an amount which shall not be less than ten
rer cent of the aggregate of the proposal, or by a bond for the said amount and so payable,
signed by the bidder at two sureties, who shall justify, before any officer competent to
administer an oath, in double the said amount, and over and above all statutory exemptions.
Said sealed eroposals or bids shall te delivered to the city clerk of the city
council. of said city, on or before 8 o'clock 2. M., on Tuesday Inc twenty-first day of
October, 1924, said time being not less than ten days from the time of the first posting
and publication of the notice of said work and inviting sealed proposals, on which day and
hour all proposals or bids will be publicly opened ay said City Council.
I hereby certify that the foregoing resolution vas duly and regularly adopted by
the city counpil of the City of Alameda at a regular meeting thereof held Tuesday. October
7th, 1924, by the following vote, to-wit:
AYES: Councilmen Latham, Probst, 2eise, Tildpn and President Otis, (5).
NOES: None.
ABUENT: Nene.

the record.
