RESOLUTION ARPROATTEG DEPORT OP COMMISSIOSERS.
WHEMEAS the counciM of the oity of Alameda did, on the 5th day of May,
pass its Resolution of intention No. 76, N. 2., to order the opening and 'extending of
Eagle Avenue in said city, candor the provisions of an act of the legislature untitled,
"An Act to provide for laying out, crooning, extending, widening. straightening, or clos
ing up in whole or in part, any street, square, lace, adluy, court or place within mun-
palitius, and to condemn and acquire any and. all land and property necessary or Q03-
vonient for that purpose," approved March 6, 1689, had amendments thereto, which resolu-
tion of intention described the work arid improvement and the land deemed necessary to be
taken therefor, and specified the exterior boundaries of the distriet of anu b to be
affected or benefited by said work and improvement, and to be assessed to pay the damage31 .

AND WHEREAS, the 'street superintendent thereupon caused to he consgicsausly
hosted along the line of said contemplated. aork ana improvement, notices of the passage
of said resolution of intention, and also caused a notice similar in substance to be
published, all in the time, Tons and mannor required by said aot,
AED WHEREAS, no persons interestud objecting to said work and improvement, or
to the extent of the district of lands to be affected 331 benefited: thereby, and to be
assessed to pay the cost and expenses thereof, made any- written objections to the same
within ten days after the expiration of the tAme of the potlication of aforesaid. notice
as authorized by said act, wherefore tht 331101 acquired jurtsdictian to order said work
to be (P33 and improvement to be made, and did, chi the 22d day of june, 1925, pass its
resolution ordering said work It he done and appointing W. E. Vercoe, Prod. J. droll and
4m. J. hocEe, as the three commissioners to assess benefits rd damages, and have general
supervision of the proposed work and improvement in accordance with the provisions of said

ADD WHEREAS, each of said commiusioners filed with the clerA. of the city council
an affidavit, and a bond to the state of 133339 13313131 in the sum of hive Thousand Dollars
$50000.00), to faithfully perform the duties of his office,
AED WHEREAS, said commissioners proceeded to view the lands described in said
resolution of intention and the land to be taken, and the improvements affected, and cons
uidered the testimony presented, whereupon they proceeded with all diligence to determine
the value of the land, and. the damage to improvements and property affected, and also the
amunnt of the expanses incident to Said work and improvement, and "1133 determined the
same they proceeded to asaess the same upon the district of lands declared benefited, the
exterior boundaries of which were fixed by said resolution of intention, said assessment
being made upon the lands within said dMstrict in proportion to the benefit to be derited
from said work and improvement, so far as the said commissioners could reasonably estimate
the same, including in sash estimate the real property of nll railroad companies within
saiR district,
AND WHEREAS, said commissioners having made theirs assessment of benefits and.

city council, whereupon said clerk gave notice of such filing by publiaation for ten
days in the Alameda Times-Star, a daily newspaper of general. circulation printed, pots

to show cause, if sny, why said report should not be confirmed, before thn city council
on or before a day fixed by the clerk thereof and stated. in oald notice, being not less
than thirty' days from the first publication thereof,
ADD WIEREASe certain objection's in writing were filed with the clerk of the
city counail, who can at the next meeting after the day fixed in sald notice to show
cause, lay the said objeetauns. before the city' colnwill, who thareugon fixbd n tdme for

AID DTEREAST it. appears that said objectors were notified by the clerk La
the same mawnar as objectors to the wriglral resolution of intention, and at the time
set the council proceeded to hear such objections and having duly' heard 3 considered
the same, now therefore it is hereby
RESOLYEL by the council of the city of Alameda that tha report of said
commissioners be and the same is hereby confirmed.
