GRANTING THE SOUTHERN PACIFIC COMPANY, ITS SUCCESSORS
AND AS3IGNS A REVOCABLE PERMIT TO CONSTRUCT AND MAIN-
TAIN A HIGHWAY OVER THE CITY'S TIDELANDS.
WHEREAS, publie interest and convenience demand the service of automobile
ferries between Alameda and San 1Francisco, and the Southern 2acific Company has pro-
posed to operate one cf such ferries and has reeuested permission to construct and
maintain a highway from the Alameda Mole over the eity's tidelands to Main Street,
now therefore be it
aESOLVED, that the Southern Pacific Company be, and it is hereby grented
a revocable permit to construct, pave and maintain a highway twenty-feur (24( feet
in width, from the Alameda Mole easterly over, along and uron the old road-bed sit-
uated on the southerly aide of the company'a existing tracks to Alameda Point; thence
curving to the right and running ever and across said company's lands to and connect-
ing with the existing pavement in Pacific Avenue.
This permiesion is granted subject to the following terms and conditions,
to-wit:
First - That the Southern Pacific Company, its successors and acsigns, will
eonstruet and pave said roadway to the satisfaction of the city engineer ef said eity;
Second - That said roadway and pavement over the city's id ands, when
co)gpleted, will 'become the property of the City of Alameda, and said city shall have
the free right to use, or authorize the use of said highway over aaid tidelande for
any and all lawful purposes.
Tnird - That the Southern Pacific Company, its successors and assigns, will
maintain id roadway and pavement in good condition and repair and to the satisfaetion
of said city engineer, so long as said roadway is ased primarily by the automobile
patrons of said company.
::;7arth - That the Southern Pacific Company will establish not leas than a
half-hourly service each day of the week beginning at six a. m. from Alameda and ran-
ning until nine r. m., and thereafter hourly until midnight; also an initial fare of
Sixty cents (60) foa each automobile and five cents (5j6) for each occupant, the same
as now in effect between San Prancisco and the Oakland Mole.
Fifth - That the Southern Pacific Company will file with the city council
a written aceeptence of the terms and covenants herein contained, which, together
with the company's application and this resolution, shall constitute a oontract.
I, the undersigned, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted by the Council of the City cf Alameda in regular
adjourned meeting assembled on the 27th day of July, 1926, by the following vote, to-wit:
YES: Councilmen Latham, Neisa, Traver and President Otie, (4).
NOES: None.
ABSENT; Councilman Noble.
