RESCINDING RESOLUTION OF INTENTION MO, 85, H.S.,
FOR THE IMPROVEMENT OF WEBSTER STREET'.
WHEREMS, the supremo out of the State of California has
just horded down, o decision ir the cash of City of Pasadena v.
MoWillaster (Vol, 75, Cal, Bee., 747), holding it to be unconstitu-
tional for a hity to include any municipelly owned property what-
ever within an assessment district, whether used. in the performance
of a public function or otherwise, whore proceedlnxs have bean
taken. under the Accuisition & lexprovement 1ct of 1925, and
WITEMEAS, as a result of said decision it becomes neces-
sary to exclude all tide and suhmergod lands from the assessmont
district, non therefore be it
REJOINED, by the Council of the City of Alameda, that
Resolution. uf Intention NO. 85, N.J., tor the improvement of Webster
Street under said act, passed Juno 5, 1920, be and the same is hereby
rescinded, and the city attorney is directed to prepare another
resolution of intention excluding said tidelands and all other
municipally owned property in ancordance with the decision uf the
supremo court cforchanntioned,
I, thd undersigned, bereby certify that the foromoing
Resolution was duly and regularly introduced and adopted by the
Council of the City' of Alameda in special meetinv thereof as-
sembled on the ldth day of June, 1026, by the fellowino vote,
to-wit:
