Resolution 01417IN T}B MATTER C iCQTJI5ITICN AND IMPROVEMENT REeOZUTION NO. 1417 RESOLUTION AND FINAL ORDER ACCEPTING THE RORK 4HEREA5, on February 19, 1929, the City CoUneil of the City of Alameda adopted its Resolution of Intention to order certain work to be done and improvements to be made in the aboveentitled matter, under and pursuant to the provisions of the Acquisition and Improvement Act of 1925, reference being hereby expressly made to aaid Resolution of Inten- tion for further particulars, and WHEREAS, said work was done accordingly, and the euperinteudent of work and the contractor have filed a verified declaration and statement of the completion of said work, amount of incidental expenses and other matters, as required by the provisions of section twenty-two (22) of said ect, and WHEREAS, the Council fixed Tuesday, the 3rd day of September, 1929, at the hour of 8 o'clock p.m. of said day, in the chamber of the City Council as the day, hour and place fur holding the final hearing, in the above-entitl- ed matter as required by said set, and it appeare from the affidavits on file with the clerk that notice of said hearing was published and pouted in the time, form and manner required by law, and "WHEREAS, the time set for said hearing having arrived, and all persons interested in any of the work or improvement done under said proceeding or in any matter affecting said work and the assessment dietrict therefor, feeling aggrieved by any action or determination done or made in said proceed- ings or claiming that any of the previous acts or proceedings are irregular, defective, erroneous or faulty, or that the work or improvement has not been performed according to the contract in a good and substantial manner, or that any portion of the work or improvement has not been performed according to the contract in a good and substantial manner, or that any portion of the work or improvement for any reason was omitted or illegally included in the contract for the same, or having any objections to offer or any mason to advance why bonds should not be ioeued in the amount set forth in the declaration and state- ment on file, have been duly granted a hearing, and the various protests and objeotions having been duly and regularly heard, weighed and considered, now therefore be it RESOLVED, determined and declared by the City Council of the City of Alameda that; in the opinion of the oounoil, the Said work has been completed and performed according to the contrast in a good and substantial manner, and that said work be and the same is hereby accepted; that the amount of the contract price for the doing of said work and imTvamont is Feity-one Thousand, Nine Hundred and Fifty-two and 29/100 Dollars, (941,952.29) and that the amount of the incidental expenses thereof and of the proceedings therefor, which are to be charged asainet and to be paid by the contractor, are Cne Thousand, One Hundred and Difty-three and 13/100 Dollars, (41,153.13). The aggregate amount fot which bonds are to be issued to the contractor or his assigns is Forty- three Thousand, One Hundred and Ave and 42/100 Dollars, (43,105.42). This resolution and order shall be entered in full upon the minutes of the council. I, the underaignedehereby.sertify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 3rd day of September, 1929, by the follow- ing vote, to wit: AYES: Coencilmen Brodersen, Caleutt, Henning, Latham and ?resident Schaefer, (5).
