IN TEE MATTER OF ACQUISITION AND ildROVEMENT
DISTRICT NO. 3 02 THE CITY OF ALAMEDA
UT '- 07 INTENTION
NO. 95 N.S.
RESOLVED AND DETERMINED, by the Council of the City of Alameda
that public interest and necessity require the improvements hereinafter
set forth and it is the intention of said council to order the following
described work to be done and improvements to be made on those certain
public was in said city, described as follows, to-wit;
That Perk Street, from its northern termination at the San
Antonio Estuary to the northern curb line of San Jose Avenue, be improved
as follows:
That the roadway thereof be widened three and one-half (3.)
feet on each side to the new curb lines, have concrete curbs, gutters,
gutter bridges and corrugated iron culverts constructed thereon of the
number, size and in the locations shown on the plane and specifications
hereinafter referred to, and that the sidewalks thereof be repaired;
also that the roadway, where widened, be paved with an asphaltie concrete
pavement between said estuary and the southern curb line of Encinal Avenue,
and an oil macadam pavement between said Encinal Avenue and the northern
curb line of San Jose Avenue.
All of said work and improvements shell be done in accordance
with the plans, profiles, detail drawings and specifications therefor
which have been approved by said council and are now on file in the
office of the clerk thereof, reference to which is hereby made for the
estimated cost of the improvement (inclueive of incidental expenses and
cost of the proceeding), for a full and detailed description end location
of said propoeed improvements and of the grades to which said improvements
are to be constructed.
The notice of all persons affected is directed to the grades
for the proposed improvement and to the provisions of the "Acquisition and
Improvement Act uf 1925" relating to grades.
The district of lends to be benefited by said proposed improvement
is hereby described as followe:
A11 the parcels or trects of land situate, lying and being within
the corporate limits of the elk/ of Alameda, according to the map thereof
approved by the council and now on file with the clerk.
Excepting from said dietrict all public ways and all lands belong-
ing to the United States and the State of California.
In the judement of the city council, there will be no varying
benefits to be derived by the different parcels of land lying within the
assessment district, es a consequence the district has not been divided
into zones.
Reference is hereby made to the plat or map entitled "Map of
Acquisition and Improvement District No, 3 of'the City of Alameda", ap-
proved by this city council September 3, 1929, end now on file in the office
of the clerk thereof, whereon there is indiceted by a boundary line, the
extent of the territory to be included in said proposed assessment
dietrict; provided that all public ways are not included in saiddietrict,
said streets and public ways being now in use in the performance of publio
function e as public highwaye.
Bonde will be issued for the expenses of the work and improve-
ments herein proposed to be done to the total amount of the expense there-
of, said bonds to bear interest at the rate of six (6) per cent per annum,
payable semi-annually, the first interest payment to be made on the
second day of January or the second day of July (whichever month first
succeeds the date of the bonds) not succeeding one year after the date
of such bonds. The aggregate principal of all bonds issued under this
proceeding shall be paid and discharged within twenty yeare after the
date of issuance, and pproximately one-twentieth part of euch aggre-
gate prinoipal shall be payable annually, as hereinafter provided, all
in Fold coin, it being the determination of this council that the first
payment on the aggregate principal of the bonds iesued will be made one
year after the issuance thereof.
A special fund for the payment of said bonds will be con-
stituted by the levy of special assessment taxes upon the lands within
the assessment district, in accordance with the provisions of said
act, according to the assessed value of said lande, exclusive of im-
provements thereon, except as otherwise provided in said act.
The proceedings for the work and improvements herein mentioned,
including the bonds to provide for the expenses thereof, shall be taken
under and in pursuance of the provisions of the "Acquisition and Improve-
ment Act of 1925".
Notice is hereby given that Tuesday, Pebruary 18, 1930, et
the hour of 8:00 o'clock p.m. of said day, in the chamber of this oity
council, in the time and place when and where any and all persons
having any objections to the proposed work and improvements or to the
propoeed grades to which the improvements are to be oonstructed, or
to the extent of the assessment district, or to any or all of the
foregoing, may appear before this city council and be heard, said time
being not less than eighteen nor more than sixty days from the date of
the adoption of this resolution.
The clerk of this council shall cause this Resolution of
Intention to be published by two insertions in the Alameda Times-Star,
a newspaper of general circulation published and circulated in the City
of Alameda, which newspaper is hereby designated as the newspaper for
making the publication of this Resolution of Intention and all other
publications in or incident to the proceedings hereof.
The City Council of the City of Alameda hereby appoints
Burnett Hamilton "Superintendent of Work", whose duty it shall be
to perform the servioes prescribed or indicated for him in said Act '
and to have general actual supervision of the improvements constructed,
without compensation.
The "Superintendent of Work" shall cause to be conspicuously
posted along the line of said contemplated work and improvements,
notices of the adoption of this resolution, in the time, form and
manner required by said Act.
the undersigned, hereby certify that the foregoing Roo1ution
was duly and regularly introduced and adopted by the Council of the City
of Alameda, in regular meeting assembled on the 21st day of January, 1930,
by the following vote, to-wit:
AYES: Councilmen Brodersen, Calcutt, Henning, Latham and Preeident
Schaefer, (5).
NOES: None.
ABSENT: None.
