AUTHORIZING PURCHASE OF CERTAIN REP:2T PEOFERTY ON PADU
STREET NEAR SAN ANTONIO AVENUE FOR DANK ITMEZFIES.
WHEREAS, in the opinion of the Council of the City of Alameda,
public interest and neceesity require that Franklin Park be enlarged;
and,
TEIEBAS, it is necessary and proper that the real property herein-
after deseribed, lying adjacent to said Franklin Fekrk, be acquired b\ .
purclaae, to be held. by the City of Alameda for the uses and purposes of
a public park; and,
WHEREAS, Ernest•..H. Creak and Ethel D. Crook, his wife, the owners of
said real proderty, have executed. and delivered to the City of Alameda
their written option, wherein they agree to convey to the City of Alameda,
for the sum of Four Thousand Five Hundred Dollars ($4500), a good and
merchantable title in fee in ood to said real property, free and clear of
all liens and encumbrances, but subject to the reservations and enceptioDs
• hereinafter specified, and providing tLlt said option be exercised by said
City on or before Novemer 15, 1933, and,
TEDREARS, said purchase price represents the fair market value of said
real. property; now, tnerefore,
DE IV' BESOTTED by- the Council of the City of Alameda that the City
of Alameda purchase, for tUe sum of Four Thousand Five Hundred Dollars
CB4500), the following described. real property situate in the. City of
Alameda, County of Alameda, State of California, more particularly des-
cribed as follows:
All of Lot 5, in. Block J, as said
lot and block are delineated and so
designated upan that certain map entitled

of the County Recorder of klameda County,
California, in Book. 6 of Zaps, Page 11,
to
be acquired and held by seed City for the uses and purposes of a public
park,
NE IT 01 10 RESOLVED that upon anproval by. the it Attorney of the.
tltle to said real property, said titio to be evidenced by the certificate
cf title issued by the Oakland Title. Insurance and Guaranty Company, the
City of Alameda accept a conveyance 4 sail real property, and that the
proper officials of the City- he, and they are hereby, authorized and
directed to do and perform all acts required. to effectuate said purchase.
SE IT Di:JEERER RESOLVED that the taxes on aaid real property, for the
fiscal year ending June 30f 19361, be assmmed by the City of Alameda.
BE IT FURTHER RESOLVED that the said owners snail. have the right to
retain possession of said real. property, free of any rental or other charge
therefor, to and includinE; the 15th day of Zencary, 1934; and they shall
further have the rll-ut to remove t1 e furnace, laundry treys, light and
plumbinm fixtures, windows, hardware, doors, built-in fixtures, inside
finish lumber, garage, plants, slruls and fences situate on said premises,
providing same be removed OR or before the 15th. day of January, 1931.
