BOARD OF PUBLIC UTILITIES COMMISSIONERS: CALLING
A SPECIAL ELYCTION TO BE HELD IN TUE CITY OF
ALAMEDA ON TUESDAY, MARCH 12, 1935, FON THE
PURPOSE OF SUBMITTING TO THE WALITIED ELECTORS
OF SAIL CITY A PROPOSAL TO AMEND THE CHARTER OF
THE CITY OF ALAMEDA: CONSOLIDATING SAIL ELECTIONC.
WHEREAS, in accordance with the provisions of Article XI, Section 8 of the
Constitution of the State of California certain proposals for amending the Charter
of the City of Alameda were duly submitted to the electors of said city. at a General
and special municipal election held in said city an November 6, 1934, which prop-
osals were duly ratified by a majority of said qualified electors voting thereon
at said election, and which proposals were known and. designated as Proposal No.
4, adding Article VIIa to said Charter, and Proposal No. 5, amending Artiole X
of said Charter, and
WHEREAS said proposals and amendments were duly submitted to, and were, and
each of ttem was, duly and regularly approved by the Legislature or the State of
California in regular session on the 14th day of ;Tanuary, 1935, for and as amend,
meats, and as part of, the Charter of said city of Alameda, and
INEEREAS one cosy, duly certified, of each of said amendments so ratified and
approved was heretofore filed with the Secretary of State of the State of Calif-
ornia, and one cony thereof, duly certified, was filed with the Recorder of the
County of Alameda, and one copy thereof, duly certified, was filed in the office
of the City Clerk of said City, and
WHEREAS Section 1 of Article Vila of said Charter as amended provides, among
other things, that within sixty days after ratification of said weendmento by the
State Legislature an election shall be held for the purpose of electing the three
commissioners to the Board o2 Police and Fire Commissioners therein created, and
WHEREAS Section 1 of Article X of said Charter as amended provides, among other
things, that within sixty days after the ratification of said amendment by
the State Legislature an election shall be held for the purpose of electing five
commissioners to the Board of Public Utilities. Commissioners therein created,
and
7,TIERE1S the Council of the City of Alameda, on its own motion, desires to
submit to the qualified electors of said pity a proposal for amending the Charter
of said City, and
WHEREAS the special elections hereinafter called are to be held on the same
day and in the same territory,
NOV THEREFORE, BE IT RESOLVED. BY TEE COUNCIL OF THE CITY OF ALAMEDA that a
special municipal election be, and is hereby called and ordered to be, held in
said City of Alameda, State of California, on Tuesday, Maroh 12, 1935, for the
purpose of electing commissioners on the Board of Police and Fire Commissioners
and on the Board of Public Utilities Commissioners of said City as follows:
Three commissioners to the office of cemmissioner on the Board of Police and
Fire Commissioners, to be elected in the manner and for terms an provided by
section 1, Article 'Ma of the Charter of the City of Alameda, as amended;
Five Commissioaers to the office of commissioner on the Board of Public
Utilities Commissioners, to be elected in the manner and for terms as provided
b section 1, Article X of the Charter of the City of Alameda, as amended;
BE IT FURTHER RESOLVED that a special election be, and is hereby, called and
ordered to be held. in said City of Alameda, on Tuesday, March 12, 1935, for the
purpose of submitting to the qualified electors of said city a proposal for am-
ending the Charter of said City of hlameda, in words and figures as follows:
PROPOSAL NO, 1.
That there be added to Article X of
the Charter of the City of Alameda a new
section, to be known as Seotion 19, and
which shall read as follows:
Sec. 19. Notwithstanding anything to
the contrary in this article contained, unless
and until the assent of two-thirds of the Qual-
ified voters of the City voting on the proposition
at
e general or special election at which the propos-
itiet Shall be lawfully submitted, shall be obtained,
neither the City nor the Department
of Public Utilities shall: (1) issue
any revenue cr other bonds or incur
any indebtedness maturing more than
one year after the date thereof, or
(2) enter into any contract, either
conditional or unconditional, creating
a change on the revenues derived or to
be derived from any public utility
service or business for a longer
period than one year, or, (3) engage
in or acquire any public utility
service or business in which the
City or said Department is not now
engaged.
BE IT FURTHER RESOLVED that the City Clerk be, and he is hereby directed
to cause such proposal for amending suet charter to be published once in the
Alameda Times-Star, a daily newspaper of general circulation, published and
circulated- in said City, and the official newenaper of said City; that said
City Clerk shall cause copies of said proposal to be printed in convenient
pamphlet form, and to be mailed to each of the Qualified electors of said
City, and slall also, until the day fixed for said election, advertise in the
aforesaid newspaper a notice that such copies may be had at his office, in the
City Hall, upon apelication therefor, all in the manner required by the Constitut-
ion of the State of California;
BB IT FURTHER RESOLVED that pursuant to the provisions of an act of the
legislature of the State of California entitled "An Aet to permit the con-
eolidation of elections, and to provide a procedure therefor,' (Stets. 1913,
page 698, as amended) said special municipal election called for the purpose
of electing ceamdszioners to the office of commissioner on the Board of Pollee
and Fire Conosissioners and on the Board of Public Utllitiee Commissioners be,
and is hereby consolidated with the special election herein called for the
purpose of submitting eaid proposal for amending the Charter of the City of
Alameda; that the election precincts, polling places, voting booths and ballots
for eech of the aforesaid seeeial elections shell in every case be the same, and
there shall be only one set of election -officers in each of such precincts, and
that the aforesaid special elections shall be held in all respects as if there
were only one election, and only one ticket or ballot shell be used thereat.
BE IT FURTHER RESOLVED that the Board of Election for each election precinct
at said consolidated special elections shall consist of one inspector, one judge
and two clerks, es authorized by the provisions of Section 1151 of the Political
Code of the State of California.
I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly introduced and adopted by the Council of the City of Elameda in
adjourned regular meeting assembled on the 25th. day of Tanuary, 1935, by the
following vote, to wit:
