AKTONIO AVENTE FOR PARK TURPOSES.
WBOREM, in the opinion of the Council of the Gity of Alameda public
interest and necesaity require that Franklin Perk in said city be enlarged;
and.
WHEREAS it is necessary and proper that the real property hereinafter
described, lying adjacent to said Franklin Park, be acquired by purchase,
to be held by the City of Alameda for the uses and purposes of a public
park; and
WHERAS Alfred W. Pya and Idabel J. Pye, his wife, the owners of said
real property, nave executed and delivered to the city of Alameda their
written option, wherein they agree to convey to the City of Alameda, for the
sum of Six Thousand Seven Hundred Fifty Dollars (§6750), a good and merehant-
able title in fee in and to said real property, free and clear of all liens
and encumbrances, but subject to the reservations and exceptions in said
option, and hereinafter specified, and on condition that said option be
exercised by said City on or before March 15, 1V45; and
WHEREAS said purchase price represents the fair market value of said
real property, and the conditions of said option are acceptable to the City,
NOW 1SEEEFORE, BE IT RESOLVED BY THE COUNCIL OF TUE CITY OF ALANTEDA
that the City of Alameda purchase from Alfred W. Pye, and Mabel J. Pye,
for the sum of Six Thousand Seven Hundred Fifty Dollars (6750), the follow-
ing described real property situate in the City of Alameda, County of
Alaneda, State. of California, more particularly described as follows;

Mars, page 11.
the sane to be acquired and held by said City Zor the uses and purposes
of a public Dark.
BE IT FrEnaER RESOLVED that upon anproval by the City Attorney of
the title to said real property, said title to be evidenced by a pol-
loy of title insurance, issued by the Oakland Title Insurance and Guar-
anty Company, the City of Alameda accept a conveyance of said real
croperty, and that the proper officials' of the City be, and they are
hereby, authorized and directed to pay the purchase price heroin stip-
ulated upon delivery' of deed, and to do and perform all acts required
to effectuate said purchase.
BE IT FURTHER RESOLVED that the second installment of City' and County'
taxes on said real property, for the fiscal year 1934-35 and subsequent,
be assumed by the City of Alameda, and that documentary stamps ard title
policy be at the expense of the City.
BB IT FURTHER RESOLVED that the said owners shall have the right to
retain possession of said real property free of any rental or other charge
therefor, to and including the 1st day of September, 1935; that they shall
have the right to remove the gas fnimeee and Pittsburg water heater from
slid premises, providing the same be removed on or before the 1st day of
September, 1935,
BE IT FURTRER RESOLVED that the sum of 36810, or so such thereof as may
be necessary, be, and is hereby appropriated out of the General Fund of said
City for the purpose of purchasing the aforesaid reel property; that said sum
be added to the budget of the City of Alameda for the fiscal year 1934-35,
and that the are be transferred from the General Tand Of said city to the
Parks Genital Account 156-b, and that the Auditor and Treasurer be, and are
hereby directed to make said transfero on their respective books.

adjourned regular meeting assembled on the 13th day of February, 1935, by the

RESOLUTION NO. 1908.
TRANSFERRING ;-31,500.00 FROM TE E ELECTRIC LIGHT
FUND TO THE GENERAL FUND.
Be it resolved by the Council of the City or Alameda that the sum
of Thirty-one Thousand Five Hundred and no/100 Dollars (431,500.00) be,
and the eerie is hereby ordered transferred from the Electric Light Fund
to the General Fund, as a dividend, same being the balance pledged in the
Budget for the year ending June 30, 1935.
The Auditor and the Treasurer of the City are hereby authorized and
instructed to make said transfer upon their respective books.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of
Alameda in regular meeting asehabled on the 19th day of February, 1933,
by the following vote, to alt:
