DECLARING RESULT OF SPECIAL MUNICIPAL ELECTION
HELD IL TH. CITY OF ALAMEDA OE TUESDAY, MARGE
12, 1935, FOR THE PURPOSE GF ELECTING COMMISS-
IONERS OW THE BOARD OF POLICE AND FIRE COMIUS3-
TONERS AND ON THE BOARD OF PUBLIC UTILITIES
CONNISSIONERS, AND SPECIAL ELECTION HELD IN THE
SAME CITY ON THE SAME DATE. FOR THE PURPOSE. OF
jliBlaTTING A PROPOSAL FOR AMENDING THE CHARTER
OF SAID CITY.
WEEREAG a spacial municipal election was called and held in the City of
Alemeda on Tuesday, March 12, 1935, under and pursuant to the provisions of
Article Vila and of Article X of the Charter of said City, for the purpose of
electing commissioners on the Board of Police and Fire Commissioners and en the
Board of Public Utilities Commissioners of said City as follows
Throe Commissioners on the Board of Police and Fire Commissioners,
for terms as follows:
One Commissioner ou said Board who shall hold office
until the third succeeding genei1 city election,
and until his successor is elected and qualified.
One Commissioner on said Board who shall hold office
until the second succeeding general city election and
until his successor is elected and qualified.
One Commissioner on said Board who shall hold office
until the next succeeding general city election, and
until his successor is elected and qualified'.
Five Commissioners on the Board of Public Utilities Commissioners.,
for terms as follows:
Three Commissioners an said Board, each. of wham shall
hold. office until the second succeeding general city
election, and until his successor is elected and qualified.
1'o Commissioners on said Board, each of whet shall hold
office until the next succeeding general city election,
and until his successor is elected and qualified,
and
WHEREAS nominating petitions were duly filed and presented to the City
Clerk in the time, form and manner prescribed by Sections 5 and 6 of Article XI
of said Charter, nominating for said offices the following persons, to-wit:

YEEREAS said nominations were entered in a list, with the offices to be
filled, which list was certified to in the time, form and manner required by
Section 8 of said Article XI, whereupon an election Jroolanaation, stating the
time of the election, the offices to be filled, and the names of the candidates
signed by the Mayor and attested by the City Clerk, was duly and regularly pub-
lished, more than ten days before said election, three times in the Alameda
Times-Star, the official paper of said City, and
WHLP4AS the City Council of the Pity of Alameda, being the legislative body
thereof, did, on the 25th day of January, 193.5, on its own motion, by Resolution
No. 1902, call a special election to be held in said city on the 12th day of
March, 1935, for the purpose of submitting: to the qualified electors of said
City a certain proposal to emend the Charter of said City pursuant to the pro-
visions of Section 8 of Article XI of the Constitution of the State of California,
which proposal read es follows, to-wit:
PROPOSAL NO. 1
That there be added to Article X of
the Charter of the City of Alameda a new
section, to be known as Section 19, and
which stall read as follows:
Sec. 19. .11otwithstanding anything
to the contrary in this article contained,
unless and until the assent of two-thirds
of the qualified voters of the City voting
on the proposition at a general or special
election at which the proposition shall be
lawfully submitted, shall be obtained,
neither the City nor the Department of Public
Utilities shall: (1)issue any revenue or
oth.er.bonds or incur any indebtedness matur-
ing more than one year after the date there-
of, or (2) enter into any contract, either
conditional or uneendttional, creating a
charge on the revenues derived or to be
derived from any public utility service
or business for a longer Period than one
year, or, (3)engage in or acquire any public
utility service or business in which the City
or said Department is not now engaged,
and
WEEMA3 by said Resolution No. 1902 of the City Council of said City, the
special municipal election called for the purpose, of electing commissioners on
the Board of Police and Fire Commissioners and on the Board of Public Utilities
Commissioners was consolidated with the special election celled for the purpose
of submitting said proposal for amending the Charter of the City of Alatede, and
it was ordered that the election precincts, polling places and voting booths for
each of said special elections be in every cane the same, that there be only
one set of election officers in each of such precincts, and that said spacial
elections be held in all respects as if there were only one election, and only
one ticket or ballot be used thereat and
7111ERE4.5 the City Clerk of the City of Alameda did file, and ounce to be
posted in t prominent place, in his office, more than twenty-five (25) days
prior to said spacial elections a notice setting forth the date of such elections,
the offices to be filled and the terms thereof, and containing the said proposed
amendment, in which notice there saes also designated the names and addresses of
the election officers who had been appointed for each precinct, and the polling
places therein, and
W112- the City Clerk also caused to be published the list of the names of
the election officers appointed, and the polling places designated for each
election precinct, in the Alameda Times-Star, a newspaper of general circulat-
ion, and the official newspaper of said City, for two issues, the last public-
ation thereof being more than one week before the date such elections were
held, and
WHEREAS there were sixty-four (64) election precincts provided for holding:
and conducting said special elections, said precincts being the same as those
provided by the Board of Supervisors of Alameda County for holding general
state and county elections, and
WHEREAS all the ballots used for said elections were rreyared, as to form
and contents, as provided by law, and a sample ballot was mailed to each regis-
tered elector more than ten whole days preceding the date of said electionzi
together with a copy of said proposed amendment, and
WHEREAS the City Council caused the said proposed charter amendment to be
published and advertised in accordance with the provisions of Section 8 of
Article XI of the Constitution of the State of California, on the 28th day of
January, 1935, in the Alameda Times-Star, a daily newspaper of general circul-
ation, and the official newspaper of said City, and in each edition thereof,
during the day of said publication, and
WHEREAS copies of said proposed charter amendment were printed in conven-
ient pamphlet form, and in type of not leas than ten point, and an advertise-
ment that copies thereof could be had upon application therefor at the office
of the City Clerk of the City of Alameda was published in said Alameda Times-
Star an the 28th day of January, 1935, and on each day thereafter until and
including the day fixed for said special elections, all as required by Section
8 of Article XI of the Constitution of the State of California, and
WHEREAS the said proposal to amend the Charter was submitted to the elect-
ors of the City at said special election, which. said croposal was set forth in
a separate column at the right side of said ballots in words and figures as
follows:

AND WHEREAS the officers appointed to conduct said elections were duly app-

provided for each precinct as required by law, and

received and canveesed, end the returns thereof ascertained, determined and
declared in the time, form and manner provided by law, and
WHEREAS the Council of the City of Alameda, at this, its next regular
meeting following said election, has met and fully canvassed the returns of
the votes cast at said special elections., as is required by law, and being
fully advised in the premises, and having the result of said canvass before
it,
NO? THERLFORE, IT IS HEREBY RESOLVED, DETEWINED AND DECLARED BY THE
COUNCIL OF THE OITY OF ALAMEDA, IND SAID COUNCIL FINDS, L3 FOLLOWS:
1. That said srecial elections were, in all respects and particulars,
held and conducted in the time, form and manner proNtidad by law, and the
charter of the City of Alameda;
2. That the vote case in the different precincts throughout the City
for the candidatea, and also on the proposed amendment to the Charter of said
City, was as follows:

BE IT FURTHER RESOLVED, DETERMINED AND DECLARED that the aforesaid Lee
FA Cavanaugh, having received the highest number of votes cast for the
office of Commissioner on the Board of Police and Fire Commissioners, was
and is hereby, declared to he duly elected as Commissioner on the Board of
Police and Fire Commissioners of the City of Alameda, to hold office until
the third succeeding general city election, and until his successor is
elected and qualified.
B2 IT FURTHER RESOLVED, DETEMdEED AND DECLARED that the aforesaid Henry
H. Shed, having received the next highest number of votes cast for the office
of Commissioner on the Board of Police and Fire Commissioners., was, and is
hereby, declared to be duly elected as Commissioner on the Board of Pollee
and Fire Commissioners of the City of Alameda, to hold office until the second
succeeding general city election, and until his successor is elected and
qualified.
BE IT FURTHER RESOLVED, DETERMINED AND DECLARED that the aforesaid David
C- Moses, having received, the next highest number of votes cast for the office
of Commissioner on the Beard of Police and Fire Commissioners, wes, and is
hereby, declared 'to be duly elected as Commissioner on the Board of Police and
Fire Commissioners of the City of Alameda, to hold office until the next suc-
ceeding general city election, and until his successor is elected and qualif-
ied,.
RE IT FURTHER RESOLVED, DETEfiLaVED AND DECLARED that the aforesaid
Edward Bowes, Eckley S. Cunningham and Paul J. Naumann, having received the
three higbest number of votes oast for the office of Commissioner on the board
of Public: Utilities Commissioners, were, and each of them was, and are, and
each of them is, hereby declared to be duly elected as Commissioner on the
Board of Public Utilities Commissioners of the City of Alameda, eeen of whom
is to hold office until the second succeeding general city Election, and until
his successor is elected and qualified.
BE IT 7URTHAR RECOLVED, DETERMINED AND DECLARED that the aforesaid John
Nh O'Dea and Charles M. Ramonowitz, having received the tuo next highest number
of votes cast for the office of Gonnissionor on the Board of Public Utilities
Commissioners, were, and each Dr them was, and are, and each, of them is, here-
by declared to be duly elected as Commissioner on the Board or Public Utilit-
ies Commissioners of the City of Alameda, each of whom is to hold office until
the next succeeding general city election, and until his successor is elected
and qualified.
BE IT FURTHER RESOLVED, DETERMINED AND DECLARED that a majority of the
qualified electors voting on said Proposal No, I voted in favor thereof, and
that said proposal is hereby declared ratified and approved for and
as an amendment to, and as part of, the Charter of said City of Alameda.
