Resolution 02017RESOLUTION NO. 2017 RATIFYING ACTION OF CITY ATTORNEY RE ELECTRIC SUB-STATION WHEREAS, since the last meeting of the City Council, the Board of Public Utilities announced its intention of proceeding with the construction of an electric sub- station on the corner of Eagle Avenue and Menturn Street, in the City of Alameda, notwith- standing such action on the part of the Board of Public Utilities would be in violation of the Zone Ordinance of the City; and, WHEREAS, the City Attorney, in response to the instructions and requirements of the presiding officer of the Council, and pursuant to the authority vested in him under Article III, Chapter II, Section 7 of the City Charter, filed a suit in the Superior Court of Alameda County, for and in the name of said City, to restrain said Board of Public Utilities from receiving or opening bids, awarding contracts, or proceeding in any manner therewith; now, therefore, be it RESOLVED by the Council of the City of Alameda that said action of the City Attorney in bringing suit on behalf of the City of Alameda, pursuant to said authority, and enjoining the Board of Public Utilities from receiving bids, awarding contracts, or taking any action in connection therewith for the oonstructien of such an electric substation be, and the sane is hereby, ratified, approved and confirmed. RESOLVED further that the action of the City Attorney in employing the Honor- able T. C. West as special counsel for the prosecution of said action be, and the same is also ratified, approved and confirmed. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in special meeting assembled on the 12th day of December, 1935, by the following vote, to-wit: AYES: Councilmen Broyles, Munro and Iresident Roebke, (3).
