RECO=NDING AWARD OF CONTRACT FOR BRANCH PUBLIC LIBRARY

WHEREAS, on December 9, 1935, the Council of the City of Alameda recommend-
ed the award of a contract for construotion of a branch publio library building in
the City of Alameda to J. J. Crodem; and,
WHEREAS, on account of the numerous irregularities in connection with his
bid, the fact that the check accompanying the bid was insuficient, that he did not
furnish a proper statement regarding the employment of labor, or submit a proper
financial report showing financial responsibility, as a result of which the resolution
recommending the award to said J. J. Grodem was rescinded; and,
WHEREAS, the plans and specifications for the construction of said branch
nubile library building were modified in certain particulars, which modifications
have been accepted and approved by the Federal Emergency Administration of Public
Works; and,
WHEREAS, the City Council, pursuant to authority cf the Federal Emergency
Administration of Public Works again duly and regularly published an advertisement
headed "Notice to Contractors' again inviting sealed bids or proposals for furnishing
all the labor, material, transportation and services for the construction of said
branch public library building on the southwest corner of Eighth Street and Santa
Clara Avenue, said city, which said bids were duly filed with the City Clerk of
the City of Alameda in the time, form and manner required by law and said advertise-
ment; and,
WHEREAS, in response to said advertisement, bids were duly and regularly
received in time, form and manner required by the rules and regulations of the
Federal Emergency Administration of Public Works and were publicly opened and public-
ly announced as follows:

Owing to irregularities in the bid form of Villadsen Bros., Inc., ead
WHEREAS, it appears that the lowest responsible bidder for doing the work
of constructing said branch. public library building is Kelly & Tulloch, now, therefore,
be it
RESOLVED by the Council of the City of Alameda that said Council hereby
recommends to the Federal Emergency Administration of Public Works that the bid of
said Kelly & Tulloch be accepted, and that said City Council be authorized to enter
into a contract with said Kelly & Tulloch forrehe construction of said branch public
library building accordingly, for the sum of 23,885.00, Item A plus Item C, and that
the certified Check of Villadsen Bros., Inc., be retained in the event of an adverse
ruling by the Federal Emergency Administration of Public Works, and that the bid
checks of E. T. Leiter & Sons and Lyons Construction Co., be returned.
RESOLVED, that three certified copies of these resolutions be sent to the
branch office of the Federal Emergency Administration of Public Works at San Fran-
cisco.

regularly introduced and adopted by the Council of the City of Alameda in adjourned
regular meeting assembled on the 14th day of January, 1936, by the following vote,
to tit :
AYES: Councilmen Broyles, Morris, Munro and President Roebke, (4).
NOES: None. ABSENT: Councilman. Eschen, (1).
