REWIRING EXECUTION OF AGREEMENT TO IMPROVE STREETS AND EASEMENTS
IN "TRACT 526, ALAMEDA, ALAMEDA COUNTY, CALIECRNIA".
WEBREAS GEORGE WINDSOR and 1GIRTHA WINDSOR, his wife, on June 21, 1938, filed with
the City Council of the City of Alameda a final map of a subdivision covering certain
lands in the City of Alameda, entitled, "Tract 526, Alameda, Alameea County, Califor-
nia"
NOW THEREFORE, BE IT RESOLVED BY TUE COUNCIL OF THE CITY OF AlaaWeEDA that as a
condition precedent to the acceptance by this Council of the streets and easements
designated on said map, the said subdividers shall, at their option, either improve
or agree to improve said streets and easements, and in the event that said subdividors
elect to enter into an agreement for such improvement said agreement shall be in
terms substantially as hereinafter set forth.
RESOLVED FURTHER that the Mayor and City Clerk be, and they are hereby respect-
ively authorized to execute and attest said agreement on behalf of the City of
Alameda, which agreement shall be substantially as follows:
AGREEMENT
THIS AGREEZN'T, made and entered into this day or Jure, 1938, by and between
GEORGE WINDSOR ANL MARTHA WINDSOR, his wife, and ThE CITY OF ALAMEDA, a Municipal
Corporation, hereinafter designated as second parties,
WITNESSETH
THAT VO-ERE..1 , first parties are the owners of certain real property situate in
the City of Alameda, County of Alameda, State of Califernia, mere particularly des-
cribed. as fellows:
Commencing at the point of intersection of the Northerly line
of Fernside Boulevard (90 feet in width) with the Easterly
line of Versailles iivenue, (60 feet in width) as said
boulevard and avenue now exist and running thence South 57°
03' East along the Noetherly line cf Fernside Boulevard
698.9 feet to a point; thence North 32° 57' East 665.0 feet,
more or less, to a point on the Southerly line of the United
States Tidal Canal, as said line is described. in the Suit
Numbered 5590 in the Suberior Court of Al oadeda County,
California and entitled, "The Unted States of Atherica, nlain-
tiff, vs. N. Crooks, et al, defendants" and recorded
September 22, 1884 in the office of the County Recorder of
Alameda County, California, in Book 278 of Deeds, at page 59,
and running thence Westerly along the Southerly line of the
United States Tidal. Canal the following courses and distances;
North 52° 431 West 96.68 feet to a pot t, North 540 411 West
100 feet to n point; North 56° 39' West 100 feet to a point;
North 58° 37' West 100 feet to a point; North 600 55' West
100 feet to a point; North. 610 341 West 1517.07 feet to a cint
on the Easterly lire of Versailles Avenue; thence South 28
19' West along the Easterly line cf Versailles avenue 50.55
feet to a point of curve to the right with a radius of 660
feet, the tangent to the curve at said point bears south 28
19' West; thence Southerly along the aro of said curve to the
right and the Easterly line of Versailles Avnrue, a distance
of 139.55 feet to a point of darve of a revarse curve to the
left with a radius of 7084.62 feet, the tangent to the curve
at said. point hears South 44° 451 16" West, thence Southerly
along the arc of said reverse curve to the left and the
Easterly line of Versailles Avenue, a distance of 420.84 feet,
more or less, to the Northeast corner of Versailles Avenue
and Fernside Houlevard, and the point of commencement.
Containing 10.306 acres of land, more or less.
and,
WHEREAS, first parties have heretofore filed with the Council of the City of
Alameda for approval a final map fur tte upose of subdividing said real property,
which map is entitled "Tract No. 526, Alameda, Alameda County, California;" and
WHEREAS, as a condition precedent to the approval of said final map and the
acceptance of the offers of dedication of the streets and easements shown thereon,
the Council of the City of Alameda, requires that first parties enter into an
agreement for the improvement of said streets and easements;
NOW THEREFORE, in consideration of the premises and the approval 01 said final
map, it is heraby agreed as follows:
(a) First parties hereby covenant and agree taat upon the approval of said.
map they will forthwith undertake and complete the improvement of all streets and
easements shown on said map, and will carry said street work, including the
installation of sewers, grading and paving, sine-walks and curbs, together with.
the provision for any usual and necessary service, to completion in accordance
with the requirements of the Ordinances of the City of Alameda and to the
satisfaction of the City Engineer, as follows:
One-half (9) of said improvements as hereinabove provided shall be completed
not later Ian April 19, 1939;
The remaining one-half of said improvements as hereinabove provided, shall
be completed not later than April 19, 1940;
Tine is the essence of this Agreement.
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and seals
