Resolution 02335RESOLUTION NO. 2335 DECLARING BUILDING SITUATED AT THE REAR OF DWELLING KNOWN AS NO. 1530 LINCOLN AVENUE, ALAMEDA, CALIFORNIA, TO BE A PUBLIC NUISANCE WHEREAS, the Building Inspector of the City of Alameda found the building or structure located at the rear of dwelling and premises known as No. 1530 Lincoln Avenue, in the City of Alameda, California, to be so dilapi- dated from old age and neglect as to be a fire menace, also a breeding place for rodents and a likely resort for vagrant or dissolute persons, whereupon he gave notice in the manner provided by Chapter 4, Title 10 of the Alameda Munici- pal Code, directing the owner to appear before the Council of the City of Alameda on Tuesday evening, August 16, 1938, at 8 o'clock p.Ma and show oause why said building should not be condemned as a public nuisance and abated as provided in said Alameda Municipal Code, and -WHEREAS, it appears that said notice was duly and regularly given by posting and mailing in the time, form and manner provided by said code, and the said matter having been duly continued from time to time, and the same having come on regularly for hearing before this Council at this time, and witnesses being sworn and testimony being given by the Building Inspector and other competent persons respecting the condition of said building, and the estimated cost Df its recon- struction, repair or removal, and the Council having duly considered the matter, NOW THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OF ALAMEDA, that the building or structure located at the rear of dwelling and premises known as No. 1530 Lincoln Avenue, in the City of Alameda, California, is no dilapidated from old age and neglect as to be a fire menace mad breeding place for rodents and a likely resort for vagrant or dissolute persons, and that by reason thereof said building: is a public nuisance; BE IT FURTHER RESOLVED that the aforesaid building or structure be, and the same is hereby, condemned as a public nuisance, and the owner thereof is hereby directed to abate said nuisance within 30 days from the date of the passage of this resolution, by having said building or structure properly reconstructed or repaired, or by having the same razed or removed; AND BE IT FURTHER RESOLVED that if said nuisance be not so abated, the Building Inspector of the City of Alameda is hereby authorized and directed to raze or remove the aforesaid building or structure, as provided by Chapter 4, Title 10 of the Alameda MUlaielpal Code, and the cost thereof shall be a lien on the lot or parcel of land upon which the same is lecated.
