Resolution 02342RESOLUTION NO. 2342 DECLARING RESULT OF GENERAL MUNICIPAL ELECTION HELD IN T CITY OF ALAMEDA ON MARCH 14, 1939 WHEREAS, a general municipal election was held in the city of Alameda March 14, 1939, under and pursuant to the provisions of Article XIX of th( said City, for the purpose of electing officers to fill the office of COIL for terms as follows: Two (2) Councilmen an the Council of said City, for two (2) full each term commencing at 8:00 &clock p.m. on the third Tuesday in and continuing for four years thereafter and until a successor is qualified; and WHEREAS, nominating petitions were duly and regularly presented to, the office of, the City Clerk of the City of Alameda in the time, form an scribed by the Charter of said City, nominating for said offices the folk to-wit: William R. Calciftt Rix Maurer Walter J. Seaborn Henry A. Weichhart and WHEREAS, said nominations were entered in a list, with the offices tc which list was certified to ih the time, for and manner required by said whereupon an election proclamation signed by the Mayor of the City of Alameda and attested by the City Clerk and containing a statement of the time of the election, the offices to be filled, the names of the candtttes and the proposition to be voted on, as the same was by the Council of the City of Alameda ordered to be printed and appear on the ballot, was duly and regularly issued more than 10 days before said election and was published twice in the official newspaper of said City, the last publication thereof being more than 5 days before the date of said election; and WHEREAS, the Council of the City of Alameaa, being the legislative body of said City, on its own motion and without a petition therefor, by its resolution No. 2331 duly passed on February 14, 1939, ordered submitted, and there was submitted, to the electors of said City at said general municipal election, a proposition for the adoption of an ordinance entitled: "Ordinance No. 681 New Series AN ORDIMUICE GrUdITINO AIM CONVEYING TO TEE UNITED STATES OE AMERICA, FOR PUBLIC PURPOSES, AND FOR A NOMINAL CONSIDERATION OF ONE DOLLAR, ALL THE RIGHT, TITLE AND INTEREST OF THE CITY OF ALAMEDA IN AND TO CERTAIN TIDE AND SUDNERGED LANDS SITUATED ON GOVERNNENT ISLAND IN BROOKLYN BASIN, SOMETIMES KNOWN AND DESIGNATED AS THE ESTUARY OF SAN ANTONIO; SAVING AND RESERVING TO SAID CITY CERTAIN EASEMENTS AND RIGHTS OF WAY THEREIN; AND AUTHORIZING THE EXECUTION OF A DEED OF GRANT CONVEYING SAID LANDS" which ordinance is fully set forth in said resolution and hereby referred to and made a part hereof; and WHEREAS, the statement of the proposition for the adoption of the aforesaid ordi- nance was by the said Council ordered to be, and was, printed on the ballot used et said general municipal election, as follows: "PROPOSITION NO. 1 SHALL TUE ORDINANCE NO, 681, New Series, entitled and being: "An ordinance granting and conveying to the United States of America, for public purposes, and for a nominal .0 consideration of One Dollar, all the right, title and ,YES. . interest of the City of Alameda in and to certain tide and . submerged lands situated on Government Island in Brooklyn . Basin, sometimes known and designated as the Estuary of San . Antonio; saving and reserving to said City certain easements .NO . . and rights of way therein; and authorizing the execution of a deed of grant conveying said lands", BE ADOPTED? and WHEREAS, there were 92 election precincts within the City of Alameda, designated and numbered consecutively from 1 to 92 inclusive, as the election precincts for holding the foresaid general municipal election, said precincts being the same as were designated, fixed and established, by the Board of Supervisors of the County of Alameda, State of California, as the election precincts for holding general state and county elections; and WHEREAS, all of the ballots used for said election were prepared, as to form and contents, as prescribed by law, and a sample ballot was mailed to each registered elector of the City of Alameda more than 10 whole days preceeding the date of said election; and WHEREAS, the City Clerk of the City of Alameda caused the aforesaid proposed ord- inance to be printed and a copy thereof, enclosed in an envolope with said sample ballot, to be mailed to each voter at least 10 days prior to said election, and WHEREAS, the officers of election for said election were duly appointed and qualified, and all election supplies furnished and election booths provided for each precinct as provided by law, and WHEREAS, the Council of the City of Alameda at this, its next regular meeting following said election, has met and fully canvassed the returns of the votes cast at said general municipal election as required by law, and being fully advised in the premis and hav ing the returns of said canvass before it, NOW THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OF ALWEDA and said Council finds, as follows: (1) That said general municipal election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law. (4) That the total number of votes caat in the City of Alameda at said election for each of the aforesaid c andidates for the office of Councilman of said City was as follows: William R. Calcutt 3392 Rix Maurer 3619 Walter T. Seaborn 3056 Henry A. Weichhart 3937 (5) That the total number of votes cast in the City of Alameda at said election for and against said Proposition No. 1 was 6914. (6) That the total number of votes cast in the City of Alameda in favor of the adoption of said proposition was 5878. (7) That the total number of votes cast in the City of Alameda against the adoption of said proposition was 1036. NOW THEREFORE BE IT RESOLVED, DETERMINED AND DECLARED that the aforesaid Rix Maurer and Henry A. Weichhart, having received respectively the highest number of votes cast for the office of Councilman, were, and are hereby declared to be, duly and regularly elected to the office of Councilman and as members of the Council of the City of Alameda, each for a term beginning at 8 o'clock p.m. on the third Tuesday in April, 1939, and continuing for 4 years thereafter and until his successor is elected and qualified. BE IT FURTHER RESOLVED, DETERMINED 4211) DECLARED that the proposition for the adoption of the aforesaid Ordinance No. 681 New Series received a majority of the votes cast thereon at such election, that a majority of the qualified electors voting on said proposed ordinance voted in favor thereof, and that said ordinance was, and is hereby declared, duly enacted and adopted and shall go into effect 10 days from this date, I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 21st day of March, 1939, by the following vote, to wit: AYES: Councilmen Carrington, Maurer, Morris and President Weichhart,(4).
