RESOLUTION OF INTENTION TO CLOSE THAT PORTION OF PARK
AVENUE LYING SOUTH OF SOUTHERLY LirE OF ROOSEVELT DRIVE
RESOLVED BY THE COURCIL OF THE CITY OF ALP:1=A that public interest and
convenience require, and said Council hereby declares its intention to order, the
closing of that portion of Park Avenue, in the City of Alameda, County of Alameda, State
of California, more particularly described as follows:
Beginning at the most Western corner of
that certain tract of land now known as Roosevelt
Drive, described in the deed from Smith Lumber
Company, a corporation, to the City of Alameda,
a municipal corporation, dated July 29, 1933, and
recorded August 7, 1933, in the Liber 2943 of
Official Records of Alameda County at page 283,
running thence North 56° 50' 30" West and along
the Southerly line of Roosevelt Drive One Hundred
Ten (110) feet to a point, said point being the
true point of commencement; thence Northerly on
a curve to the left, tangent to said line, the
radius of which curve is Ten (10) feet, a. distance
of Fifteen and 71/100 feet; thence North 56° 501
30" West Sixty (60) feet to a point; thence Westerly
on a curve of Ten (10) fe6t radius, the center of
which curve lies North 56 50' 30" West Ten (10)
feet from last said point, a distance on said curve
of o Fifteen and 71/100 feet to e point; thence South
56 501 30" East Eighty (80) feet to the point of
commencement.
RESOLVED FURTHER that no land is deemed necessary to be taken, or will be
taken, for the work and improvement of closing said street, and that the exterior
boundaries of the district of lands to be affected or benefitted by said work ar
improvement, and to be assessed to pay the damages, costs and expenses thereof, are
the corporate boundaries of the City of Alameda; that no lands will be assessed to
pay the damages, costs and expenses of said improvement.
The Street Superintendent of the City of Alameda shall cause notices of
the passage of this resolution to be conspicuously posted along the lines of said
contemplated work and improvement and in the time, form and manner required by law.
He shall also cause a notice, similar in substance, to be published for a period of
ten (10) days, and for at least four (4) successive semi-weekly insertions in the
Alameda Times-Star, a daily newspaper of general circulation published and circulated
in said City, and hereby designated by the said City Council as the newspaper in
which said notice shall be published.
Any person interested objecting to said work or improvement, or to the
extent of the district of lands to be affected or benefitted by said work or
improvement, and to be assessed to pay the costs and expenses thereof, may make
written objections to the same within ten days after the expiration of the time of
the publication of said notice, and deliver said objections to the clerk of the
City Council as required by law.
All the herein proposed work and improvement of closing said street, or
parts of street aforementioned, shall be done under and in pursuance of an act of the
Legislature entitled, "An act to provide for laying out, opening; extending, widening,
straightening or closing up in whole or in part any street, square, lane, alley, court
or place within municipalites, and to condemn and acquire any and all land and
property necessary or convenient for that purpose," approved March 6, 1889, (Stets.
1889, p. 70) and amendments thereto.
I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly introduced and adopted by the Council of the City of Alameda in regular
meeting assembled on the 21st day of March, 1939, by the following vote, to wit:
AYES: Councilmen Carrington, Maurer, Morris and President Weichhart, (4).
NOES: None, ABSENT: Councilman Codfrey,(1).
