GRANTING PERMIT TO THE PACIFIC TELEPHONE AND TELEGRAPH
COMPANY OVER CERTAIN PARCELS OF LAND, BEING PORTIONS
OF LOT 4 OF "PLAT OF THE NORTON PROPERTY, ALAMEDA, CAL."
WHEREAS, a certain indenture dated February 1, 1939, made by and between
DAVID LASKIN and ETHEL HESKIN, his wife, CLEMENTINE SEASORN, THOS. O'D. BUCKLEY, RALPH
G. LIILLEa and MIRIAN MILLER, his wife, as grantors, and the CITY OF ALAMEDA, a municipal
corporation, as grantee, conveying to said City of Alameda. certain easements and rights
of way over, under, along, and/or across certain parcels of land situated in the City
of Alameda, County of Alameda, State of California, bounded and described as follows:
"PARCEL I:
Beginning at the point of intersection of the Northeast
line of Lot 4 with the Northwestern line of Grand Street, es said
lot and street are shown on the Map hereinafter referred to; thence
Northwesterly along said line of Lot 4 a distance of 288 feet; thence
et right angles Southwesterly 5 feet; thence at right angles South-
easterly 288 feet to a point on said line of Grand Street; thence
Northeasterly along said line of Grand Street 5 feet to the point of
beginning
Being a portion of Lot 4, as said lot is delineated and
so designated upon that certain map entitled, "Plat of the Norton
Property, Alameda, Cal." filed March 22, 1879 in Liber 5 of Maps',
page 4, in the office of the County Recorder of Alameda County.
:PARCEL II:
Beginning at a point on the Northwestern line of Grand
Street 155.666 feet Southwest of the point of intersection of the
northeast line of Lot 4 with said line of Grand Street, as said
lot and street are shown on the map hereinbefore referred to; thence
at right angles Northwesterly 120 feet; thence et right angles
Southwesterly 5 feet; thence at right angles Northwesterly 70 feet;
thence at right angles Southwesterly 5 feet; thence at right angles
Southeasterly 120 feet; thence at right angles Northeasterly 5 feet;
thence at right angles Southeasterly 80 feet to a point on said line
of Grand Street; thence at right angles Northeasterly along said line
of Grand Street 5 feet to the point of beginning",
has been duly executed and delivered to the City of Alameda by said grantors and has
been accepted by said City; and
WHEREAS, it is the desire of the owners of said tract end also in the
public interest that all role linos, overhead wires end cables and the appurtenances
thereto be located on said parcels rather than on the public streets of the tract; and
WHEREAS, the Council of the City of Alameda finds it convenient and not
detrimental to the interests of the City to use said parcels for jointly owned poles and
pole lines with The Pacific Telephone and Telegraph Company;
SE IT THEREFORE RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that a
permit be, and is hereby, granted to The Pacific Telephone and Telegraph Company to
construct, maintain and/or erect poles and pole lines, underground conduits and manholes,
cables and wires, over, under, along and/or across said parcels, for the purpose of
rendering telephone and telegraph services; with the right of ingress and egress from
said parcels; under the condition' that said The Pacific Telephone and Telegraph Company
in the use of said parcels, shall construct and/or maintain its structures in conformity
with all State, County, or City laws, ordinances, resolutions or orders pertaining to such
construction, es may be currently in force or enacted in the future; and under the further
condition that any specific usage of said parcels by The Pacific Telephone and Telegraph
Company shall be in conformity with all such laws, ordinances and resolutions and shall
be approved by the General Manager of the Public Utilities Board or other officers of the
City of Alameda having jurisdiction in the premises.

I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda in
regular meeting assembled on the 18th day of April, 1939, by the following vote, to wit:
AYES: Councilmen Carrington, Godfrey, Meurer and President Weichhart, (4).
NOES: None. AaSENT: Councilman Morris, (1).
