Resolution 02352RESOLUTION NO. 2352 EMPLOYING I.S. SHATTUCK, PLANNING ENGINEER, TO MAKE NECESSARY STUDIES AND REPORTS FOR A COMPREHENSIVE LAND USE OR ZONING PLAN FOR THE CITY OFALAMEDA WHEREAS, public interest requires and this Council deems it necessary, in order to promote the general welfare, that R new and comprehensive land use or zoning plan, including new use districts map and zoning ordinance, be prepared and adopted for the City of Alameda; and WHEREAS, the preparation of such ordinance, land use maps and comprehensive zoning plan requires that extensive surveys and studies of all material and pertinent factors be made, and it is advisable and necessary that the expert services end recom- mendations of a planning engineer, skilled and experienced in city planning and zoning problems, be secured to assist the City Planning Board and this Council in performing the task to be undertaken; and WHEREAS, such services are of a professional, scientific and technical character; and WHEREAS, I.S. Shattuck, a planning engineer and consultant, has submitted to this Council a proposal wherein he has outlined the scope and extent of the surveys, re- ports and services required for the preparation and completion of such comprehensive zoning plan and has offered to furnish such surreys and reports and to perform such services for a specified sum; and WHEREAS, the City Planning Board oT the City of Alameda has heretofore recommended to this Council that the preparation of such comprehensive zoning plan, use districts map and zoning ordinance be undertaken and that the services of said I.S. Shattuck be secured for such purposes; NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF HHE CITY OF ALAMEDA that the City of Alameda enter into an agreement of employment with said I.S. Shattuck for the furnishing of such surveys, reports maps and services, which agreement shall be, sub- stantially, in fort and contein the agreements and stipulations following, to-wit: AGREEMENT This agreement made and entered into this day of April, 1939, by and between tha City of Alameda, a municipal corporation, hereinafter called the first party, and T.S. Shattuck, hereinafter designated as the second party, WITNESSETH: That for and in consideration of the mutual covenants, agreements and conditions herein contained, it is hereby agreed by and between the respective parties hereto, as follows: 1. Second party hereby agrees to make and furnish for first party all necessary surveys, studies, maps and reports and to perform. such services as may he required for the preparation and completion of a new and comprehensive land use or zoning plan, use districts maps and new zoning ordinance for the City of Alameda, and more particularly enumerated and outlined as follows: 1. STATEMENT CY ALL NECESSARY 1WRK FOR CITY OF A.LN1EDA ZONINg STUDY A. Base Maps 1. Make new city map on a scale of 200 feet to the inch. It will probably be necessary to place lot lines on the tracing of this map after a van dyke negative has first been made of the tracing without lot lines. 2. Secure enlargement of 20C foot map to a scale of 100 feet to the inch, in sections (or secure set of 100' County Assessor's Maps). 2. Graphic Record of the existing use of each piece of proner•ty in the city 1. Use Sanborn Insurance Atlas to transfer onto the sectional 100 map, the use of each piece of property. Uses will be shown in colored convention. 2. Check this sectional map by investigating each piece of property in the field. 3. Transfer the record of existing conditions to the 200' map. This map is for study purposes in laying out the zoning plan and will show: a. The use of each piece of property in the city. Different property and building uses will be shown on the map in contrasting colors. b. The height, in stories, of each building over ai stories. c. The number of separate family accomodations in each dwelling. d. Dwellings in the rear of other buildings. e. Combinations of different uses on the same lot. C. Statistical Record (for the entire city and for various portions of it) 1. Total number of buildings devoted to various residential uses, and to business, industrial, public and semi-public uses, 2. Total area in the city occupied by each type of use. Total area of public streets and of vacant lend. 3. Total feet of frontage ef business uses. Number and feet of frontage of vacant business buildings. 4. Population trends. D. Preparation of Zoning Plan 1. From study of map of existing uses and statistics there will be determined the various kinds of zones needed. These zones will then be laid out on e map and their sizes (particularly the sizes cf business zones) will be adjusted to obtain areas of each that are adequately large (hut not too large) for present conditions and future development. The map when completed will he in colors and will be the re- commended zoning plan. 2. On the recommended zoning plan or on a separate map, there will be shown each use that is non-conforming, such as a store in a proposed residential zone, or an industry in a proposed commercial (retail business) zone. E. erstion of Zoning Ordinance The ordinance will contain regulations es to: 1. Uses allowed in the various zones. 2. Building height limits in the various zones. 3, Yard sizes and lot ereas required for buildings, Particularly in the residential zones. 4. Procedure for amendments to zoning plan and adjustments to prevent unnecessary hardships that might be imposed by the strict letter of the ordinance. F. Preparation of Final Report The recommended zoning plan and ordinance will be submitted to the Commission in company with e final report, which will include: 1. Description of procedure in preparation of clan. 2, Summary and analyses of etatistics. .3. Reasons for the plan and ordinance being as recommended, including discussion of peculiar conditions difficult of solution. 4. Recommended procedure for adoption of ordinance by Commission and Council. SCOPE OF ACTIVITIES OF 1.5. SHATTUCK CITY OF ALAYEDA ZONING STUDY. A. Direction of Basic Studies 1. Direct the preparation of maps and statistics a. Base maps b. 100' map for field checking c. 200' men of existing uses d. Non-conforming use map e. All statistics 2. Conduct the field check of uses of property. 3. Study conditions peculiar to the city and outline the basis of zoning plan and ordinance while maps and studies are under way. 4. Appear in person before the Commission (three times during progress of work) to report progress and discuss zoning problems. B. Preparation of Zoning Plan and. Ordinance. 1. Prepare zoning plan and ordinance 2. Prepare report for submission to Commission accompanying recommended zoning plan and ordinance. 3. Attend evening meetings and conferences for a period of six weeks after date of report - meetings to be not more than six in number. 4. Supervise the preparation of zoning map for publication if official adoption of ordinance is obtained within the six week period. Map drafting personnel for this map to be furnished by the City of Ala:cede. The foregoing enumeration is not exclusive, it being the intent and purpose of the parties hereto that second party shall furnish such reports, maps, data and other information and matters, and perform such services, whether or not herein specifically enumerated, as may be reasonably required for the completion of the project to be under- taken. 2. Second. party agrees that he will personally supervise and be responsible for all work to be done under this contract and that he will furnish at his own expense all drafting materials end supplies and all drafting or other personnel that may be required in the performance of the services and in the completion of the matters herein contemplated, except that first party shall bear all blue printing and photostatic costs necessary for map reproduction and shall supply, as needed, necessary drafting table or tables and drafting space in the City Hall end shall make available the City's Sanborn Insurance Atlas for use by second party and his assistants. 3. Second party shell commence the preparation and making of the surveys, studies, maps, reports, etc,, to be made and furnished. as set forth in the preceding paragraph, immediately upon execution of this agreement and shall diligently prosecute the same to completion in accordance with the following schedule: (a) The following portion. of said. work shall be completed during the Period beginning on the date of execution hereof and ending June 30, 1939: 1. Completion of the drafting of the new city map at a scale of 200 feet to the inch (without lot lines). 2. Placing or correct property ownership lines on a map at a scale of 100 feet to the inch (this map to be enlargements of the first map or to - be sections of the County Assessor's map). 3. 10% completion of the transfer of use of property (on the main island of Alemada), from the Sanborn Insurance Atlas to the 100 foot scale sectional map, this to be done in colored convention. 4. 10% completion of the field check of use of property for the main island of Alameda. For the completion of the foregoing, first party agrees to pay second party the total sum of 01,375.00, payable semi-monthly at the rate of 275,00 for each semi-monthly period ending on the 15th and on the lest day of each calendar month, during the aforesaid period; (b) The balance of the work contemplated herein shall be performed during the period beginning July 1, 1939 and ending November 30, 1939, and first-party agrees to pay second party therefor the total sum of 02,125.00, payable semi-monthly at the rate of 0275.00 for each semi-monthly period ending on the 15th and on the last day of each calendar month to and including October 15, 1939, and one final payment of 0200.0C on completion of performance by second party under this contract. The semi-monthly payments specified to be made under sub-divisions (a) and (b) of this paragraph shall be made only upon presentation by second party to the City Manager of a written statement of the work performed during the immediately preced- ing semi-monthly period- If the City Manager is satisfied that the work as reported in said statement has been performed and that the volume of the work done in such semi- monthly period beers substantially the same proportion to the whole work to be per- formed during each of said larger periods, respectively,as the amount of payment bears to the whole compensation to be paid during each such larger periods, he shall approve the demand and, upon allowance by the Council, the same shall be raid with warrants drawn on tha treasury of the City. 4. In the event of illness or disability of second party which shall prevent the continuous prosecution of work by him, time for completion may be extended by the Council; and should second party permanently discontinue the work for any cause, or fail to complete the same within the time herein specified or any extension which may be granted, he shall then be paid only such portion of the whole as will compensate him for the work performed, and in such event all surveys, maps, reports and other data, made or prepared Sy second party and his assistants, shall be delivered to the City of Alameda and shall be and remain the property of the City.
