AUTHORIZING ENGINEERING AND TRAFFIC INVESTIGATION FOR THE
CONSTRUCTION OF A OUSAWEOUS TUNNEL BETEEN 1116 CITY OF
ALAMEDA AND THE CITY OF OAKLAND; APPROVING THE FORM OF
AGREEMENT FOR CONTRIBUTIONS FOR SUCH INVESTIGATION FROM THE
CITY OF OAKLAND AND THE COUNTY OF ALAMEDA AND AUTHORIZING
TITE EXECUTION THEREOF; ESTABLISHING A SUBAQUEOUS TUNNEL
FUND AND APPROPRIATING AND TRANSFERRING 41500,00 TO SAID
FUND FCR SUCH INVESTIGATION
WHEREAS, in the in e est of and in order to promote the commerce of the
City of Alameda, and in order to improve the means of communication and expedite
travel between the City of Alameda and the City of Oakland and other localities, it is
necessary that a subaoueous tunnel be constructed under the Estuary of San Antonio
between the City of Alameda and the City of Oakland; and
WEEREAS, it is necessary that a proper engineering and traffic investigation
be made to determine the approximate cost and definite location of said subaqueous tunnel;
and
WHEREAS, the Council of the City of Alameda, by its Resolution No. 2340,
adopted March 7, 1939. appropriated out of the funds of the City of Alameda not other-
wise appropriated the sum of 41,500.00 to partially defray the cost of said proposed
investigation; and
WHEREAS, the City of Oakland and the County of Alameda propose to extend
financial aid to the City of Alameda to the extent of contributing the sum of 41,500.00
each, to defray and pay for the cost of said proposed investigation, the said sums to be
paid to the City of Alameda and by it expended in the manner and under the terms and
conditions more particularly set forth in e form of agreement to be entered into between
the City of Alameda, the City of Oakland and the County of Alameda, which form of agree-
ment has bean submitted to this Council et this its regular meeting held June 6, 1969;
NOW THEREFORE BE IT RESOLVED BY 1HE COUNCIL OF THE CITY OF ALAMEDA, as
follows:
1. That a proper engineering and traffic investigation be made by the City
of Alameda to determine the approximate cost and definite location of a subaqueous tunnel
between the City of Oakland and the City of Alameda under the Estuary of San Antonio;
2. That it is in the public interest and for the benefit of the residents
of the City of Alameda that such investigation be made;
3. That the form of agreement between the City of Alameda, the City of
Oakland and the County of Alameda referred to in the preamble hereof be, and the sere
is hereby, approved and ordered filed with the City Clerk of the City of Alameda;
4. That the Mayor of the City of Alameda be, and is hereby, authorized and
directed to execute, and the City Clerk to attest, for and on behalf of the City of
Alameda, an agreement in the form and containing the terms, covenants and agreements
set forth in the aforesaid form of agreement;
b. That there be and there is hereby created e speciel trust fund of the
City of Alameda, which fund shall be known and designated as the "Subaqueous Tunnel Fund";
6. That the sum of 31,600.00 heretofore appropriated and set aside by this
Council pursuant to said Resolution No. 2340, adopted March a, 1939, be, and is hereby,
appropriated and set aside and shall be used to defray and pay for the cost of said pro-
posed investigation, and that said VIM he, and is hereby, transferred from Budget Account
70-L to said Subaqueous Tunnel Fund and the Auditor and Treasurer of the City of Alameda
are hereby authorized and directed to make the necessary transfers on their respective
books;
7. That the sum of 4)1,600.00 be paid by the City of Oakland end the sum of
01,500.00 to be paid by the County of Alameda, as and when paid to and received by the
City of Alameda, shall be deposited in said Subaqueous Tunnel Fund;
8. That the sums so deposited in said Subaqueous Tunnel Fund shall not be
withdrawn in whole or in part except for the purpose of paying for the cost of having
a proper engineering and traffic investigation made to determine the approximate cost
and definite location of a subaqueous tunnel proposed to be constructed between the
Cities of Oakland and Alameda under the Estuary of San Antonio; that prior to the
expenditure of any of said sums by the said City of Alameda, the indebtedness shall be
authorized and approved in the manner prescribed by law for said City of Alameda; that
if after such investigation has been completed, there remains on hand any unexpended
nortion of the money paid into said fund by the County of Alameda, City of Oakland
and City of Alameda, such unexpended portion of the said fund anal' be by the City
of Alameda refunded ratably to the County of Alameda, City of Alameda and City of
Oakland;
9. That upon completion of said investigation, the City of Alameda shall
direct its proper officer to file with the Auditor of the County of Alameda and the
Auditor of the City of Oakland an account of the entire cost of said investigation,
together with a certificate that the sums expended have been applied exclusively
toward the cost of said investigation and not otherwise.

duly and regularly introduced and adopted by the Council of the City of Alameda in
regular meeting assembled on the 6th of June, 1939, . by the following vote, to wit:
