Resolution 02462RESOLUTION NO. 2462 CANCELLING CITY TAKES ON REAL PROPERTY ACQUIRED BY THE VETERANS! WELFARE BOARD 01? THE STATE OF CALIFORNIA WHEREAS, the City of Alameda heretofore assessed and levied taxes for general municipal purposes against certain. parcels of real property situated in the City cf Alameda, County of Alameda, Etete of California, hereinafter more particularly referred to, which taxes were assessed and levied respectively for the years and in the amounts and to the persons hereinafter set forth, to it (a). Taxes for 1939-40, second installment, in the amount of $18.47; Assessed to Central Building and Loan Association; On portions of Lots 5 and 6, "Plat of the Norton Property, Alameda, Cal.", as described before the widening of Lincoln Avenue. (4), Taxes for 1939-40, second installment, in the amount of tt29.47; Assessed to Vaile S. Andrus and Edna A. Andrus; On Lot 201 in Bleck L, as said Lot and Block are delineated and so designated upon that certain Map entitled "FERNSIDE, Alameda, California, May 1925", filed Tune 9, 1925 in Liter 4 of Maps, pages 76 and 77, in the office of the County Recorder of Alameda Cottnty, the parcels of land hereinbefore referred to being respectively more particularly described in the verified petition. of the Veterans! Welfare Board of the State of California bearing the date February 5, 1940; and WHEREAS, it satisfactorily appearing to this Council from said verified petition on file with the Council of the City Of Alameda, and this Council upon satisfactory proof thereof so finds, that after the time that said assessments und taxes became a lion respectively on the said parcels of real property said parcels of real broperty were acquired and owned, and ever since have been and now are owned, by the IN-Aerate, Welfare Board cf the State of California, a public cor- poration, and. because of such public ownership are not subject to sale for de- lincuent taxes; and WHEREAS, the aforesaid taxes and assessments levled on said respective parcels of land, in the amounts respectively hereinbefore sot forth, are uncol- lected and unpaid; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF Thl CITY OF ALAMEDA, the written consent of the City Attorney of the City of Alameda having been given heretofore as required by law, that the aforesaid uncollected taxes and assess- ments charged or levied by the City of Alameda for city purposes upon the afore- said DdICeiS of real property, together with all penalties and costs thereon be, and the same are hereby, cancelled, and the Auditor and Tax Collector or other officer of the City of Alameda having the custody of the record thereof, are hereby' authorized. and directed to cancel such taxes and assessments so levied or charged, together with all penalties and costa thereon, and to make appropriate entries and record of such 'lL-t ion on their respective books; and BE TI FURTHER RESOLVED, anything in this resolution to the contrary notwithstanding, that this resolution and order shall not be construed as can-, ceiling or authorizing the cancellation of any taxes or assessments levied or charged against any possessory interest in said. parcels of real property or of any seeeial assessment taxes levied against said parcels of real property by the City' of Alameda pursuant to the provisions of the "Acquisition and Improve- ment Act of 1925. I, the undersigned, hereby certify that the foregoing Resolution was duly and. regularly introduced and adopted by the Council of the City cf Alameda in. regular meeting assembled. an the 20th day of February, 1940, by the following vote, to wit: AY-2,3: Councilmen Carrinirbon, Codfray, Maurer, Morris and Prusident Weichhart, (5).
