RESOLUTION OF INTENTION TO CLOSE PORTIONS OF CLAY
STREET AND FILIIEORE STREET IN THE CITY OF ALAMEDA.
RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that public interest
and convenience require, and said Council hereby declares its intention to
order, the closing up of those portions of the following names streets in the
City of Alameda, County of Alameda, State of California, desoribed as follows:
Clay Street, from the scutheasterly line of
Court Street to the northwesterly line of
Fountain Street;
Clay Street, from the southeasterly line of
Fountain Street to the northwesterly line of
High Street;
Clay Street, from the southeasterly line of
High Street to the northwesterly line of
Post Street;
Clay Street, from the scutheasterly line of
Post Street to the northwesterly line of
Peach Street;
That portion of Clay Street described as follows;
Beginning at the point of intersection of the
northeasterly line of Clay Street with the
northwesterly line of Market Street; running
thence along the northeasterly line of Clay
Street 191.48 feet to a point; thence in e
straight line southwesterly to a point on the
southwesterly line of Clay Street, which point
is distant thereon 150.18 feet from the north-
westerly line of Market Street; thence along
the southwesterly line of Clay Street 1.50.18
feet to the northwesterly line of Market Street;
thence in e straight line northeasterly to the
point of beginning;
(f) Fillmore Street, from the southeasterly line of
High Street to the northwesterly line of Post
Street;
(g) Fillmore Street, from the southeasterly line of
Post Street to the northwesterly line of Peach
Street;
(h) Fillmore Street, from the southeasterly line of
Peach Street to the northwesterly line of Market
Street.
The portions of said streets to be closed up and abandoned are more
particularly shown in red upon a plat annexed hereto and made a part hereof,
RESOLVED FURTHER that no land is deemed necessary to be taken, or will
be taken, for the work and improvement of closing said streets, and that the ex-
terior boundaries of the district of lands to be affected or benefitted by said
work or improvement, and to be assessed to pay the damages, costs and expenses
thereof, are the corporate boundaries of the City of Alameda; that no lands will
be assessed to pay the damages, costs and expenses of said improvement.
The Street Superintendent of the City of Alameda shall cause notices
of the passage of this resolution to be conspicuously posted along the lines of
said contemplated work and improvement and in the time, form and manner required
by law. He shall also cause a notice, similar in substance, to be published for
a period of ten (10) days and for a period embracing at least four (4) successive
semi-weekly insertions, in the Alameda Times-Star, a daily newspaper of general
circulation published and circulated in, said City, and hereby designated by the
seid City Council as the newspaper in which said notice shall be published.
Any person interested objecting to said work or improvement, or to the
extent of the district of lands to be affected or benefitted by said work or im-
provement, and to be assessed to pay the costs and expenses thereof, may make
written objections to the same within ten (10) days after the expiration of the
time of the publication of said notice, and deliver said objections to the clerk
of the City Couacil as required by law.
All the herein proposed work and improvement of closing said streets,
or parts of streets aforementioned, shall be done under and in pursuance of an
act of the Legislature entitled, "An act to provide for laying out, opening,
extending, widening, straightening or closing up in whole or in part any street,
square, ,lane, alley, court or place within municipalities, and to condemn and
acquire any and all land and property necessary or convenient for that purpose",
approved March 6, 1889, (Stets. 1889, p. 70) and amendments thereto.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 16th day of July, 1940, by the following
vote, to wit:
AYES: Councilmen Carrington, Godfrey, Maurer, Morris and President
Weichhart, (5).
NOES: None.
ABSENT: None.
