ORDERING. TILE CLOSING- OF PORTIONS OF CLAY STREET AND
FILLMORE STR1E2 IE TEE C 77, ALAT,TDA.,:
WHEREAS, the Council of the City of Alameda did, on the 10th day of
September, 1940, pass its resolution No. 2522, declaring its intention to order
the closing up of those certain portions of Clay Street and Fillmore Street
more particularly described in said resolution of intention as follows.:
(a) Clay Street, from the southeasterly line of Court
Street to the northwesterly line of Fountain Street;
(b) Clay Street, frcm the southeasterly line of Fountain
Street to the northwesterly line of Hieh. Street,
(c) Clay Street, from the soetheasterly line of High
Street to the northwesterly line of Fast Street;
(d) Fillmore Street, from the southeasterly line of
High Street to the northwesterly line of Post Street;
(e) Fillmore Street, from the southeasterly line of Post
Street to the/northwesterly line of Peach Street,
situated in the City of Alameda, County of Alameda, State of California; and
WHEREAS, no land was deemed necessary to be taken, or will be taken,
for the work' and improvement of closine said street, and the exterior boundaries
of tte district or lands to be affected or benefited by said work or improvement,
and to be assessed to pay the damages, costs and expenses thereof, are the cor-
porate boundaries of the City of Alameda; and
WHEREAS, it appears that it is not necessary tc assess any lands tc
pay the damages, costs and expenses of oaid improvement; and
WHEREAS, on the 16th day of September, 1940, the Street Superintendent
of the City of Aloimeda caused to be conspicuously posted along the lines of said
contemplated work and improvement, at not more than 300 feet in distance apart,
and not lass than three in all, notices of the passage of said resolution, in
time, form and manner required by law; and
WHEREAS, the said Street Superintendent also caused a notice, similar
in substance, to be published for a period of ten days, and for at least four
successive semi-weekly insertions, in the Alameda Timos-Star, a daily newspaper
of general circulation published and circulated in said City and designated by
said Council for that purpose, said publication commencing on the llth day of
September, 1940, and continuing thereafter in each and every issue of said news-
paper until and including the 24th day of Certember, 1940, and
WHEREAS, proof of said posting and publication is evidenced by affi-
davits on file in the office of the City Clerk of said City; and
WNEREAS, no person interested or objecting to said work or improvement,
or to the extent of the district of lands to be affected or benefited by said
work and improvement and to be assessed to pay the costs and expenses thereof,
has made written objection to said work and improvement, and no written objec-
tion to said work and improvement has been filed with said City Clerk, within
ten days after the expiration of the time of the publication. of said notice, or
at any time or at all; and
WHEREAS, the time prescribed, during which objections to said work and
improvement could be made, has expired, and this Council having acquired juris-
diction to take action in said matter; and
WHEREAS, public interest and convenience require the closing up of said
portion of said street;
NOW, THEREFORE, BE IT RESOLVED BY THE COCECIL CF TEE CITY OF ALATZDA,
that public interest and convenience require the closing up of said portions of
said Clay Street and said Fillmore Street,
RESOLVED, FURTHER, that the portions of Clay Street and Fillmore Street,
in the City of Alaneda, County of Alameda, State of California, hereinbefore more
particularly described, be, and the same are hereby ordered to be, closed and
abandened.
The portions of said streets closed. and abandoned as aforesaid are more
particularly shown in red upon a plat annexed hereto and made e part hereof,
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in adjourned regular meeting assembled on the Sth day of October, 1940, by the
following vote, to wit:
AYES: Councilmen Carrington, Godfrey, Maurer, Morris and President
Weichbart, (5).
NOES: None.
ABSENT: None.
