ACCEPTING CONVEYANCE FROM SOUTHERN PACIFIC 00.10AN7I
OF CERTAIN LANDS IN WEST ALAMEDA FOR STREET PURPOSES
AND CONSENTING TO THE RECORDATION THEREOF.
WHEREAS, by 0 v No. 789, New Series, passed February 10, 1.942,
the Council of the City of Alameda authorized the acquisition from Southern Pacific
Company, a corporation, of an easement for street or highway purposes upon and
across certain lauds situated in the City of Alameda, County of Alameda, State of
California, more particularly described as follows:
BEGINNING at Station 178 in the exterior line of o0at
portion of the Peralta Rancho or Grant confirmed and patented
to Antonio Maria Peralta by the Government of the United States
as oaid line is delineated and designated or that certain nap
filed in Book 25 of Maps, pages 74 to 78, iaclueive, in the
office of the County Recorder of said County of Alameda and
entitled "Map of Alameda Marsh Land, etc." thence North 46* 23'
25" East, 127.09 feet to the southwesterly line of Farcel No. 1
described in the deed from the Southern Pacific Company to
United Engineering Company, Ltd., dated. May 17, 1941; thence
southeasterly along said southwesterly line on a curve to the
right, having a radius of 1484.197 feet to a point that bears
South 42* 32' 45" East, 64.91 feet from the point of beginning
of said curve; thence South 06* 23' 25" West, 143.02 feet to
the southwesterly line of Tract 41 as shown. on said "Map of
Alameda Marsh Land, etc.;" ttence North 28* 49' West thereon,
67.13 feet to the point of beginning, containing 0.20 of an
acre, more or leas;
and
VOIEREAS, said Southern Pacific Company has executed and delivered to the
City its Indenture, dated February 10, 1942, conveying to the City of Alameda an
easement for street or highway purposes over and across said lands;
NOW, THEREFORE, SN IT RESOLVED EY THE COMMIE CF THE CITY OF ALAMEDA that
the aforementioned indenture be, and the same is hereby, accepted on behalf of the
City of Alameda, and said City Council, acting for and ia behalf of said City,
hereby consents to the recordation of said indenture and orders this resolution to
be attached thereto, as required by Section 1158 of the Civil Code of the State of
California.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly intreduced acid adopted by he Council of the City of Alameda
in regular meeting assembled on the 17th day ef March, 1942, by the following'
vote, to sit:
AYES: Ocansilmen Howe, Junes and. President Godfrey, (5).
NOES: None.
ABSENT: Qounciimen Branseheid and Maurer, (2).
