WHEREAS, The Regents of the University of California, a corporation, is
the owner of said property and has offered to convey said real property to the City
of Alameda for street and highway purposes, for the consideration of $950.00, and
subject to the reversion of title under certain contingencies hereinafter more
particularly set forth; and
WHEREAS, the purchase price to be paid by the City, together with any
obligation imposed on the City in connection with the acquisition of said real
property is less than $1,000.00;
NOW, THEREFORE, RE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA as
follows:
(1) That the aforesaid real property be acquired by the City of Alameda,
subject to and on the following terms andconditions:
(a) That title in fee simple in said real property be conveyed to the
City of Alameda by good and sufficient deed of grant vesting title in said City
free and clear of all objections, liens and encumbrances, except taxes and assess-
ments for the fiscal year 1944-1945 and subsequent years, and subject to the fur-
ther condition that upon the closing or abandonment of any street or highway which
heretofore has been or hereafter may be laid out and established by the City of
Alameda upon the hereinabove described parcel of real property, or upon any part
thereof, the title to such parcel, or part thereof, as the case may be, shall at
once revert to and ravest in The Regents of the University of California, free
and clear of any right or claim of interest by, in, or of the City of Alameda;
(b) That title to said real property be evidenced by a policy of title
insurance for $1,000.00, issued by Oakland Title Insurance and Guaranty Company,
insuring the City's title and showing the record title in the lands hereinbefore
described to be vested in the City of Alameda as provided in the next preceding
paragraph.
(2) The Auditor of the City of Alameda is hereby authorized and directed
to issue e warrant of the City drawn against the Treasurer of said City, in the
amount of Nine Hundred and Fifty Dollars ($950.)0), payable to the order of The
Regents of the University of California, and the same is hereby ordered to be
placed in escrow with said title company, for delivery to The Regents of the
University of California on delivery and recordation of said deed and the
approval by the City Attorney of said title policy.
(3) The sum of Nine Hundred and Seventy-four Dollars ($974.00) is
hereby appropriated from the Street Improvement Fund of the City to pay for
the agreed purchase price of said real property and the cost of said title
policy.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 18th day of April, 1944, by the following
vote, to wit:
AYES: Councilmen Branscheid, Howe, Jones, Osborn and. President
Godfrey, (5).
NOES: None,
ABSENT: None.
