PROVIDING FOR EXTRA COMPENSATION FOR CITY SERVICE
PERFORMED DURING VACATION -PERIOD.
WHEREAS, under the provisions of Art. 4, Ch. 5, Title II of the Alameda
Municipal Code every officer and employee of the City of Alameda who has been
continuously in city service for more than. one year is entitled to an annual
vacation with full pay during each calendar year; and
WHEREAS, due to the widespread manpower shortage prevailing in this
area many of the departments and offices of the City are undermanned and it is
impossible to find competent persons for regular employment or for vacation
relief;
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA as follows:
1. That whenever any person, other than an elective officer, whose
salary or compensation is fixed by this Council, shall, with the approval of
the City Manager, work or perform city service in his or her office or position
during any portion of the time that such person is entitled to be on regular
annual vacation leave, such person shall receive for each day's work during
such vacation period, in addition to his or her regular salary or wage for such
day, an additional daily compensation computed as hereinafter provided.
2. Such additional compensation shall be granted subject to the fol-
lowing provisions and conditions:
(a) The officer or employee shall request vacation leave in the regu-
lar manner and shall indicate in writing his or her willingness to work during
such vacation period or a portion thereof under the conditions specified in
this resolution.
(b) The head of the department in which such officer or employee is
employed, or the board or other official body having jurisdiction and power of
appointment over such person, shall determine whether the vacation shall be
granted for the time requested and if granted shall notify the City Manager,
stating the date of commencement of the vacation, that the officer or employee
has requested permission to perform city service during such vacation period,
and giving his recommendation as to whether the services of such officer or
employee are needed for vacation work. If the City Manager approves vacation
work for such person he shall thereupon notify the Executive Secretary of the
Civil Service Board of the fact that vacation leave has been granted, the date
of commencement thereof, and that such person has agreed to perform, and has
been granted permission to perform, vacation work during such vacation period
or portion thereof.
(e) For persons whose compensation is fixed on a monthly basis the
daily rate of extra compensation payable for a day's work during such vacation
period shall be computed by dividing the regular monthly salary by twenty-six,
and the hourly rate shall be computed by dividing the regular monthly salary
by 208. For officers or employees employed on a monthly basis in city offices
which close at noon on Saturday, working Saturday morning shall be deemed as
one day.
(d) For persons whose compensation. is fixed on a daily basis the
daily rate of extra compensation for such vacation work shall be the same as
the regular daily rate and the hourly rate of such extra compensation shall
be computed by dividing the regular daily rate by eight.
(e) For persons employed on an hourly basis the hourly rate of extra
compensation for vacation work shall be the same as the regular hourly rate at
which the person is employed.
(f) Whenever any officer or employee shall have received extra com-
pensation for working during any part of his or her vacation period as herein
provided, the number of days to which such officer or employee was entitled to
be absent from duty on vacation leave with pay during the calendar year shall
be diminished by the number cf days for which he or she received such extra
compensation—
Nothing in this resolution is intended or shall be construed as
repealing or superseding any of the provisions of any salary resolution hereto-
fore or hereafter adopted by this Council fixing the regular salary or compen-
sation of city officers and employees for ordinary and regular service.
RESOLVED, FURTHER, that this resolution shall be in effect immediately
upon its adoption and shall remain in effect to and including, but not after,
December 31, 1944.
